88 AN ACT
99 relating to a pilot program awarding grants for the provision of
1010 personalized treatment protocols for homeless veterans diagnosed
1111 with substance use disorders.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subtitle B, Title 2, Health and Safety Code, is
1414 amended by adding Chapter 49 to read as follows:
1515 CHAPTER 49. PILOT PROGRAM FOR HOMELESS VETERANS DIAGNOSED WITH
1616 SUBSTANCE USE DISORDERS
1717 Sec. 49.001. DEFINITIONS. In this chapter:
1818 (1) "Pilot program" means the pilot program
1919 established under this chapter.
2020 (2) "Veteran" means an individual who has served in:
2121 (A) an active or reserve component of the army,
2222 navy, air force, coast guard, or marine corps of the United States;
2323 or
2424 (B) the Texas National Guard, as defined by
2525 Section 431.001, Government Code.
2626 Sec. 49.002. ESTABLISHMENT AND OPERATION OF PILOT PROGRAM.
2727 (a) The commission, using available resources and in cooperation
2828 with the Texas Veterans Commission, shall establish and operate a
2929 pilot program to award grants for the provision of personalized
3030 treatment protocols to at least 100 homeless veterans diagnosed
3131 with a substance use disorder.
3232 (b) A grant recipient under the pilot program must be able
3333 to provide to a homeless veteran participating in a personalized
3434 treatment protocol:
3535 (1) mental health and substance use disorder treatment
3636 services;
3737 (2) medical detoxification or medical withdrawal
3838 services;
3939 (3) supportive housing for the duration of treatment;
4040 (4) partial hospitalization; and
4141 (5) intensive outpatient treatment.
4242 (c) A grant recipient under the pilot program shall
4343 collaborate with a local government or nonprofit organization to
4444 connect homeless veterans participating in a personalized
4545 treatment protocol with transitional housing resources, workforce
4646 training, and long-term mental health and substance use disorder
4747 treatment services that will be available to the veteran after
4848 successfully completing the personalized treatment protocol.
4949 (d) The commission may award a grant under the pilot program
5050 only in accordance with a contract between the commission and a
5151 grant recipient. The contract must include provisions under which
5252 the commission is granted sufficient control to ensure the public
5353 purpose of providing treatment to homeless veterans is accomplished
5454 and the state receives the return benefit.
5555 (e) The commission may accept gifts, grants, and donations
5656 to operate the pilot program.
5757 Sec. 49.003. RULES. The executive commissioner shall adopt
5858 rules to implement this chapter.
5959 Sec. 49.004. REPORT. Not later than October 1, 2026, the
6060 commission shall prepare and submit to the governor, the lieutenant
6161 governor, the speaker of the house of representatives, and the
6262 appropriate standing committees of the legislature a report that
6363 includes:
6464 (1) information on the number of homeless veterans who
6565 were provided a personalized treatment protocol under the pilot
6666 program; and
6767 (2) an evaluation of the pilot program's
6868 effectiveness.
6969 Sec. 49.005. EXPIRATION. The pilot program concludes and
7070 this chapter expires September 1, 2027.
7171 SECTION 2. As soon as practicable after the effective date
7272 of this Act:
7373 (1) the executive commissioner of the Health and Human
7474 Services Commission shall adopt the rules necessary to implement
7575 Chapter 49, Health and Safety Code, as added by this Act; and
7676 (2) the Health and Human Services Commission shall
7777 establish and begin operating the pilot program under Chapter 49,
7878 Health and Safety Code, as added by this Act.
7979 SECTION 3. This Act takes effect September 1, 2025.
