77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the unlawful possession of a firearm by a person
1010 convicted of certain felony offenses.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 46.04, Penal Code, is amended by
1313 amending Subsection (a) and adding Subsection (a-2) to read as
1414 follows:
1515 (a) A person who has been convicted of a felony described by
1616 Subsection (a-2) commits an offense if the person [he] possesses a
1717 firearm:
1818 (1) after conviction and before the fifth anniversary
1919 of the person's release from confinement following conviction of
2020 the felony or the person's release from supervision under community
2121 supervision, parole, or mandatory supervision, whichever date is
2222 later; or
2323 (2) after the period described by Subdivision (1), at
2424 any location other than the premises at which the person lives.
2525 (a-2) Subsection (a) applies only to a felony:
2626 (1) that has as an element the intentional or knowing
2727 use, attempted use, or threatened use of force; or
2828 (2) under any of the following provisions of the Penal
2929 Code:
3030 (A) Title 5;
3131 (B) Section 25.02;
3232 (C) Section 25.04;
3333 (D) Section 25.08;
3434 (E) Section 28.02;
3535 (F) Chapter 29;
3636 (G) Section 30.02;
3737 (H) Section 42.02;
3838 (I) Section 42.072;
3939 (J) Section 42.09;
4040 (K) Section 42.091;
4141 (L) Section 42.092;
4242 (M) Section 42.10;
4343 (N) Section 42.105;
4444 (O) Section 43.05;
4545 (P) Section 43.25;
4646 (Q) Section 43.251; or
4747 (R) Title 12.
4848 SECTION 2. The change in law made by this Act applies only
4949 to an offense committed on or after the effective date of this Act.
5050 An offense committed before the effective date of this Act is
5151 governed by the law in effect on the date the offense was committed,
5252 and the former law is continued in effect for that purpose. For
5353 purposes of this section, an offense was committed before the
5454 effective date of this Act if any element of the offense occurred
5555 before that date.
5656 SECTION 3. This Act takes effect September 1, 2025.
