46 A BILL TO BE ENTITLED
57 AN ACT
68 relating to reporting by the Texas Education Agency and the
79 comptroller on school finance.
810 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
911 SECTION 1. Subchapter A, Chapter 48, Education Code, is
1012 amended by adding Section 48.011 to read as follows:
1113 Sec. 48.011. SCHOOL FINANCE REPORT. (a) Not later than
1214 December 31, 2025, the agency and the comptroller shall jointly
1315 prepare and submit to the legislature a report on school finance
1416 since the state fiscal year beginning September 1, 1994.
1517 (b) The report must include for each state fiscal year
1618 covered by the report:
1719 (1) the amount appropriated for school finance for
1820 that fiscal year from each source of funding, including
1921 differentiating:
2022 (A) the amount collected from school districts
2123 under Chapter 49 or former Chapter 41;
2224 (B) amounts disbursed from the Foundation
2325 Schools Program; and
2426 (C) and amounts disbursed from the state general
2527 fund;
2628 (2) the items for which the money was spent,
2729 including:
2830 (A) administrative costs, both in total and
2931 disaggregated by type of cost; and
3032 (B) distribution to school districts and
3133 open-enrollment charter schools;
3234 (3) the amount, if any, transferred to or used for
3335 another purpose, including each purpose for which the money was
3436 transferred or used; and
3537 (4) the amount, if any, not spent for that fiscal year
3638 and retained by the agency.
3739 (c) This section expires September 1, 2026.
3840 SECTION 2. Section 48.273, Subchapter F, Chapter 48,
3941 Education Code, is amended by adding Subsection (h) to read as
4042 follows:
4143 (h) All reporting pertaining to the Foundation School
4244 Program and any other education funding shall, regardless of use,
4345 reflect all funds collected under Chapter 49 or former Chapter 41 as
4446 "local recapture funding" and be differentiated from "state
4547 funding" in all reports.
4648 SECTION 3. This Act takes effect immediately if it receives
4749 a vote of two-thirds of all the members elected to each house, as
4850 provided by Section 39, Article III, Texas Constitution. If this
4951 Act does not receive the vote necessary for immediate effect, this
5052 Act takes effect September 1, 2025.
