| 8 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 11 | | SECTION 1. Subchapter A, Chapter 48, Education Code, is |
|---|
| 10 | 12 | | amended by adding Section 48.011 to read as follows: |
|---|
| 11 | 13 | | Sec. 48.011. SCHOOL FINANCE REPORT. (a) Not later than |
|---|
| 12 | 14 | | December 31, 2025, the agency and the comptroller shall jointly |
|---|
| 13 | 15 | | prepare and submit to the legislature a report on school finance |
|---|
| 14 | 16 | | since the state fiscal year beginning September 1, 1994. |
|---|
| 15 | 17 | | (b) The report must include for each state fiscal year |
|---|
| 16 | 18 | | covered by the report: |
|---|
| 17 | 19 | | (1) the amount appropriated for school finance for |
|---|
| 18 | 20 | | that fiscal year from each source of funding, including |
|---|
| 19 | 21 | | differentiating: |
|---|
| 20 | 22 | | (A) the amount collected from school districts |
|---|
| 21 | 23 | | under Chapter 49 or former Chapter 41; |
|---|
| 22 | 24 | | (B) amounts disbursed from the Foundation |
|---|
| 23 | 25 | | Schools Program; and |
|---|
| 24 | 26 | | (C) and amounts disbursed from the state general |
|---|
| 25 | 27 | | fund; |
|---|
| 26 | 28 | | (2) the items for which the money was spent, |
|---|
| 27 | 29 | | including: |
|---|
| 28 | 30 | | (A) administrative costs, both in total and |
|---|
| 29 | 31 | | disaggregated by type of cost; and |
|---|
| 30 | 32 | | (B) distribution to school districts and |
|---|
| 31 | 33 | | open-enrollment charter schools; |
|---|
| 32 | 34 | | (3) the amount, if any, transferred to or used for |
|---|
| 33 | 35 | | another purpose, including each purpose for which the money was |
|---|
| 34 | 36 | | transferred or used; and |
|---|
| 35 | 37 | | (4) the amount, if any, not spent for that fiscal year |
|---|
| 36 | 38 | | and retained by the agency. |
|---|
| 37 | 39 | | (c) This section expires September 1, 2026. |

| 38 | 40 | | SECTION 2. Section 48.273, Subchapter F, Chapter 48, |
|---|
| 39 | 41 | | Education Code, is amended by adding Subsection (h) to read as |
|---|
| 40 | 42 | | follows: |
|---|
| 41 | 43 | | (h) All reporting pertaining to the Foundation School |
|---|
| 42 | 44 | | Program and any other education funding shall, regardless of use, |
|---|
| 43 | 45 | | reflect all funds collected under Chapter 49 or former Chapter 41 as |
|---|
| 44 | 46 | | "local recapture funding" and be differentiated from "state |
|---|
| 45 | 47 | | funding" in all reports. |
|---|
| 46 | 48 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 47 | 49 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 48 | 50 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 49 | 51 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 50 | 52 | | Act takes effect September 1, 2025. |
