88 AN ACT
99 relating to the Rural Economic Development and Investment Program
1010 and the Texas economic development fund.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Sections 12.0271(a) and (b), Agriculture Code,
1313 are amended to read as follows:
1414 (a) From funds appropriated for that purpose, the
1515 commissioner shall establish and administer a financial assistance
1616 program to encourage private economic development in rural areas.
1717 Financial assistance under the program may be provided only to:
1818 (1) a county with a population of not more than 200,000
1919 [75,000];
2020 (2) a municipality with a population of not more than
2121 50,000; [or]
2222 (3) a public utility owned by a municipality described
2323 by Subdivision (2);
2424 (4) a political subdivision not described by
2525 Subdivision (1) or (2), including a special district, that is
2626 wholly or partly located in a county described by Subdivision (1);
2727 or
2828 (5) an economic development corporation, [or]
2929 community development financial institution, or other lender that
3030 primarily represents a county or municipality described by this
3131 subsection.
3232 (b) Financial assistance under Subsection (a) may be used
3333 only for a project relating to:
3434 (1) the acquisition or development of land, easements,
3535 or rights-of-way;
3636 (2) attracting new private enterprises to the county
3737 or municipality, including:
3838 (A) manufacturing facilities;
3939 (B) freight storage facilities;
4040 (C) distribution warehouse centers; [and]
4141 (D) mineral extraction activities, as defined by
4242 Section 2270.0051, Government Code; and
4343 (E) other nonretail private enterprises;
4444 (3) the construction, extension, or other improvement
4545 of:
46- (A) water or waste disposal facilities; or
46+ (A) water or waste disposal facilities; [or]
4747 (B) transportation infrastructure; or
48+ (C) energy generation, transmission, and
49+ distribution facilities; or
4850 (4) any other activity relating to private economic
4951 development that the commissioner determines will encourage
5052 economic and infrastructure development in a rural area.
5153 SECTION 2. Section 12.0272(b), Agriculture Code, is amended
5254 to read as follows:
5355 (b) Money in the Texas economic development fund is
5456 dedicated to and may be appropriated only to the department for the
5557 purposes of administering, continuing, implementing, or
5658 maintaining:
5759 (1) an economic development program originally
5860 established as part of the department's implementation of the State
5961 Small Business Credit Initiative; or [and]
6062 (2) one or more of the department's economic
6163 development programs:
6264 (A) established to encourage the export of Texas
6365 agricultural products or products manufactured in rural Texas; or
6466 (B) established through an agreement with a
6567 federal agency, foreign governmental entity, local governmental
6668 entity, nonprofit organization, private entity, public university,
6769 or state governmental entity to encourage rural economic
6870 development in this state.
6971 SECTION 3. Section 12.0273, Agriculture Code, is amended by
7072 amending Subsections (c), (d), and (e) and adding Subsections (e-1)
7173 and (h) to read as follows:
7274 (c) The term of a loan made using money from the fund may not
7375 exceed 20 years. [A loan must require monthly payments of principal
7476 and interest beginning not later than the 90th day after the date
7577 the loan is made.]
7678 (d) The department shall administer the fund as a perpetual
7779 source of financing for loans and grants under this section. The
7880 department shall use payments of principal and interest to make
7981 additional loans and grants. Subject to Subsection (f), the
8082 department may use any money in the fund to make additional loans
8183 and grants.
8284 (e) The cumulative amount of [loans and] grants to any
8385 person using money from the fund may not exceed $1 million.
8486 (e-1) The maximum aggregate amount of outstanding loans to
8587 any one person at any time using money from the fund may not exceed
8688 $1 million.
8789 (h) The department may adopt rules for the repayment of a
8890 loan or grant made under this section.
8991 SECTION 4. Section 12.0273, Agriculture Code, as amended by
9092 this Act, applies only to a loan or grant made on or after the
9193 effective date of this Act.
9294 SECTION 5. This Act takes effect September 1, 2025.
