| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subtitle C, Title 5, Business & Commerce Code, is |
|---|
| 11 | 11 | | amended by adding Chapter 121 to read as follows: |
|---|
| 12 | 12 | | CHAPTER 121. ONLINE GLOBAL MARKETPLACES |
|---|
| 13 | 13 | | Sec. 121.001. DEFINITION. In this chapter, "online global |
|---|
| 14 | 14 | | marketplace" means a person that: |
|---|
| 15 | 15 | | (1) provides for consideration, including |
|---|
| 16 | 16 | | consideration deducted as a fee from the transaction, an online |
|---|
| 17 | 17 | | application, software, an Internet website, a system, or another |
|---|
| 18 | 18 | | medium through which a good or service in this state is advertised |
|---|
| 19 | 19 | | or offered to the public as available; and |
|---|
| 20 | 20 | | (2) is not regulated by this state; and |
|---|
| 21 | 21 | | (3) directly or indirectly provides or maintains an |
|---|
| 22 | 22 | | Internet platform for goods or services by: |
|---|
| 23 | 23 | | (A) providing a payment system that facilitates a |
|---|
| 24 | 24 | | transaction between two platform users; |
|---|
| 25 | 25 | | (B) transmitting or otherwise communicating the |
|---|
| 26 | 26 | | offer or acceptance of a transaction between two platform users; |
|---|
| 27 | 27 | | (C) owning or operating the electronic or |
|---|
| 28 | 28 | | physical infrastructure or technology that brings two or more |
|---|
| 29 | 29 | | platform users together; |
|---|
| 30 | 30 | | (D) providing a virtual currency, as defined by |
|---|
| 31 | 31 | | Section 12.001, that platform users are allowed or required to use |
|---|
| 32 | 32 | | to transact; or |
|---|
| 33 | 33 | | (E) providing software development or research |
|---|
| 34 | 34 | | and development activities related to any of the activities |
|---|
| 35 | 35 | | described by this subdivision. |
|---|
| 36 | 36 | | SECTION 2. Chapter 250, Local Government Code, is amended |
|---|
| 37 | 37 | | by adding Section 250.014 to read as follows: |
|---|
| 38 | 38 | | Sec. 250.014. REGULATION OF ONLINE GLOBAL MARKETPLACE |
|---|
| 39 | 39 | | PROHIBITED. (a) In this section, "online global marketplace" has |
|---|
| 40 | 40 | | the meaning assigned by Section 121.001, Business & Commerce Code. |
|---|
| 41 | 41 | | (b) A county or municipality may not: |
|---|
| 42 | 42 | | (1) regulate the operation of an online global |
|---|
| 43 | 43 | | marketplace; or |
|---|
| 44 | 44 | | (2) require an online global marketplace to provide |
|---|
| 45 | 45 | | personally identifiable information of its Internet platform users |
|---|
| 46 | 46 | | without an administrative subpoena or court order. |
|---|
| 47 | 47 | | SECTION 3. This Act takes effect September 1, 2025. |
