88 relating to regulation of online global marketplaces.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subtitle C, Title 5, Business & Commerce Code, is
1111 amended by adding Chapter 121 to read as follows:
1212 CHAPTER 121. ONLINE GLOBAL MARKETPLACES
1313 Sec. 121.001. DEFINITION. In this chapter, "online global
1414 marketplace" means a person that:
1515 (1) provides for consideration, including
1616 consideration deducted as a fee from the transaction, an online
1717 application, software, an Internet website, a system, or another
1818 medium through which a good or service in this state is advertised
1919 or offered to the public as available; and
2020 (2) is not regulated by this state; and
2121 (3) directly or indirectly provides or maintains an
2222 Internet platform for goods or services by:
2323 (A) providing a payment system that facilitates a
2424 transaction between two platform users;
2525 (B) transmitting or otherwise communicating the
2626 offer or acceptance of a transaction between two platform users;
2727 (C) owning or operating the electronic or
2828 physical infrastructure or technology that brings two or more
2929 platform users together;
3030 (D) providing a virtual currency, as defined by
3131 Section 12.001, that platform users are allowed or required to use
3232 to transact; or
3333 (E) providing software development or research
3434 and development activities related to any of the activities
3535 described by this subdivision.
3636 SECTION 2. Chapter 250, Local Government Code, is amended
3737 by adding Section 250.014 to read as follows:
3838 Sec. 250.014. REGULATION OF ONLINE GLOBAL MARKETPLACE
3939 PROHIBITED. (a) In this section, "online global marketplace" has
4040 the meaning assigned by Section 121.001, Business & Commerce Code.
4141 (b) A county or municipality may not:
4242 (1) regulate the operation of an online global
4343 marketplace; or
4444 (2) require an online global marketplace to provide
4545 personally identifiable information of its Internet platform users
4646 without an administrative subpoena or court order.
4747 SECTION 3. This Act takes effect September 1, 2025.
