9 | 9 | relating to the possession of a firearm by persons convicted of | |
10 | 10 | certain felony offenses. | |
11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Section 46.04(a), Penal Code, is amended to read | |
13 | 13 | as follows: | |
14 | 14 | (a) A person who has been convicted of a felony offense | |
15 | 15 | listed in Article 42A.054(a), Code of Criminal Procedure, commits | |
16 | 16 | an offense if the person [he] possesses a firearm: | |
17 | 17 | (1) after conviction and before the fifth anniversary | |
18 | 18 | of the person's release from confinement following conviction of | |
19 | 19 | the felony offense or the person's release from supervision under | |
20 | 20 | community supervision, parole, or mandatory supervision, whichever | |
21 | 21 | date is later; or | |
22 | 22 | (2) after the period described by Subdivision (1), at | |
23 | 23 | any location other than the premises at which the person lives. | |
24 | 24 | SECTION 2. The change in law made by this Act to Section | |
25 | 25 | 46.04(a), Penal Code, applies to an offense committed before, on, | |
26 | 26 | or after the effective date of this Act. However, a final | |
27 | 27 | conviction for an offense that exists on the effective date of this | |
28 | 28 | Act remains unaffected by this Act. | |
29 | 29 | SECTION 3. This Act takes effect September 1, 2025. |
