77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the possession of a firearm by persons convicted of
1010 certain felony offenses.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 46.04(a), Penal Code, is amended to read
1313 as follows:
1414 (a) A person who has been convicted of a felony offense
1515 listed in Article 42A.054(a), Code of Criminal Procedure, commits
1616 an offense if the person [he] possesses a firearm:
1717 (1) after conviction and before the fifth anniversary
1818 of the person's release from confinement following conviction of
1919 the felony offense or the person's release from supervision under
2020 community supervision, parole, or mandatory supervision, whichever
2121 date is later; or
2222 (2) after the period described by Subdivision (1), at
2323 any location other than the premises at which the person lives.
2424 SECTION 2. The change in law made by this Act to Section
2525 46.04(a), Penal Code, applies to an offense committed before, on,
2626 or after the effective date of this Act. However, a final
2727 conviction for an offense that exists on the effective date of this
2828 Act remains unaffected by this Act.
2929 SECTION 3. This Act takes effect September 1, 2025.
