97 AN ACT
10- relating to the disclosure of certain fraud detection information
11- obtained in the administration of the unemployment compensation
12- system.

1310 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
14- SECTION 1. Subchapter F, Chapter 301, Labor Code, is
15- amended by adding Section 301.087 to read as follows:
16- Sec. 301.087. CERTAIN FRAUD DETECTION INFORMATION NOT
17- PUBLIC INFORMATION. (a) In this section, "fraud detection
18- information" means any information, including risk assessments,
19- reports, data, protocols, technology specifications, manuals,
20- instructions, investigative materials, crossmatches, mental
21- impressions, and communications, that may reveal the methods or
22- means by which the commission prevents, investigates, or evaluates
23- fraud in its administration of Subtitle A.
24- (b) Fraud detection information is not public information
25- for purposes of Chapter 552, Government Code, and is excepted from
26- the requirements of Section 552.021 of that code.
11+ SECTION 1. Section 301.085, Government Code, is amended by
12+ amending Subsections (a) and (c) to read as follows:
13+ Sec. 301.085. UNEMPLOYMENT COMPENSATION, [AND] JOB
14+ MATCHING SERVICES INFORMATION, AND FRAUD DETECTION INFORMATION;
15+ OFFENSE; PENALTY. (a) In this section:
16+ (1) "Job matching services information" means
17+ information in the records of the commission that pertains to the
18+ commission's job matching services provided to employers and job
19+ seekers through the Internet, workforce centers, or other means.
20+ (2) "Unemployment compensation information" means
21+ information in the records of the commission that pertains to the
22+ administration of Subtitle A, including any information collected,
23+ received, developed, or maintained in the administration of
24+ unemployment compensation benefits or the unemployment
25+ compensation tax system.
26+ (3) "Fraud detection information" means any
27+ information, including risk assessments, reports, data, protocols,
28+ technology specifications, manuals, instructions, investigative
29+ materials, crossmatches, mental impressions, and communications
30+ that may reveal the methods or means by which the commission
31+ prevents, detects, investigates, or evaluates fraud in the
32+ administration of unemployment compensation benefits and the
33+ unemployment compensation tax programs.
34+ (c) Unemployment compensation information, [and] job
35+ matching services information, and fraud detection information are
36+ not public information for purposes of Chapter 552, Government
37+ Code.
2738 SECTION 2. This Act takes effect immediately if it receives
2839 a vote of two-thirds of all the members elected to each house, as
2940 provided by Section 39, Article III, Texas Constitution. If this
3041 Act does not receive the vote necessary for immediate effect, this
3142 Act takes effect September 1, 2025.
