77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the apprenticeship system of adult career and
1010 technology education.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 61.8235(a), Education Code, is amended
1313 to read as follows:
1414 (a) The board, with the assistance of institutions of higher
1515 education, career and technical education experts, and college and
1616 career readiness experts, shall establish alignment between the
1717 college and career readiness standards and the knowledge, skills,
1818 and abilities students are expected to demonstrate in career and
1919 technical education by establishing programs of study that:
2020 (1) incorporate rigorous college and career readiness
2121 standards, including career and technical education standards that
2222 address both academic and technical content;
2323 (2) support attainment of employability and career
2424 readiness skills;
2525 (3) progress in content specificity by beginning with
2626 all aspects of an industry or career cluster and leading to more
2727 occupationally specific instruction or by preparing students for
2828 ongoing postsecondary career preparation;
2929 (4) incorporate multiple entry and exit points with
3030 portable demonstrations of technical or career competency, which
3131 may include credit transfer agreements or industry-recognized
3232 certifications; and
3333 (5) culminate in the attainment of:
3434 (A) an industry-recognized certification,
3535 credential, or license;
3636 (B) a registered apprenticeship;
3737 (C) an apprenticeship certified by the Texas
3838 Workforce Commission as an industry-recognized apprenticeship
3939 program as provided by commission rule;
4040 (D) a [or] credit-bearing postsecondary
4141 certificate; or
4242 (E) [(C)] an associate or baccalaureate degree.
4343 SECTION 2. Section 133.001(1), Education Code, is amended
4444 to read as follows:
4545 (1) "Apprenticeship training program" means a
4646 training program that provides on-the-job training, preparatory
4747 instruction, supplementary instruction, or related instruction in
4848 a trade that has been:
4949 (A) certified as an apprenticeable occupation by
5050 the Office of Apprenticeship; or
5151 (B) recognized as an apprenticeable occupation
5252 by the commission as provided by commission rule.
5353 SECTION 3. Sections 133.002(d) and (h), Education Code, are
5454 amended to read as follows:
5555 (d) Each apprentice participating in a program must be given
5656 a written apprenticeship agreement by the apprenticeship committee
5757 stating the standards and conditions of the apprentice's employment
5858 and training. The standards must conform substantially with the
5959 standards of apprenticeship for the particular trade which have
6060 been adopted by the Office of Apprenticeship or by the commission by
6161 rule.
6262 (h) A program must be:
6363 (1) registered with the Office of Apprenticeship and
6464 approved by the commission; or
6565 (2) certified by the commission as an
6666 industry-recognized apprenticeship program as provided by
6767 commission rule.
6868 SECTION 4. Chapter 133, Education Code, is amended by
6969 adding Sections 133.0025 and 133.0065 to read as follows:
7070 Sec. 133.0025. PRE-APPRENTICESHIPS FOR CERTAIN HIGH SCHOOL
7171 STUDENTS. The commission by rule shall establish procedures and
7272 standards by which the commission may allocate funds available for
7373 the support of apprenticeship training programs under this chapter
7474 to support pre-apprenticeships designed for high school students
7575 enrolled in career and technical education programs of study
7676 leading to employment in high-wage, high-demand occupations. The
7777 standards must:
7878 (1) be developed in coordination with the Texas
7979 Education Agency or Texas Higher Education Coordinating Board; and
8080 (2) ensure that any committee overseeing a
8181 pre-apprenticeship:
8282 (A) excludes from its membership any bargaining
8383 agent representing apprenticeable occupations certified by the
8484 Office of Apprenticeship;
8585 (B) includes at least one member who is a
8686 representative of a community-based organization that demonstrates
8787 evidence of success in coordinating and managing job placement
8888 services for at least one industry served by the committee; and
8989 (C) maintains, as a majority of the committee's
9090 membership, members who represent employers.
9191 Sec. 133.0065. PUBLICATION OF WAGE OUTCOMES. The
9292 commission shall publish on the commission's Internet website and
9393 include in the unified repository for education and workforce data
9494 developed under Section 2308A.005, Government Code, wage outcome
9595 data for apprentices who complete an apprenticeship training
9696 program.
9797 SECTION 5. Section 133.007, Education Code, is amended to
9898 read as follows:
9999 Sec. 133.007. RULES. The commission shall adopt
100100 [promulgate] rules necessary to implement the provisions of this
101101 chapter, including rules establishing:
102102 (1) which occupations are recognized by the commission
103103 as an apprenticeable occupation, based on criteria which must
104104 include that the occupation:
105105 (A) be a high-wage, high-demand occupation;
106106 (B) be customarily learned in a practical way
107107 through a structured, systematic program of on-the-job supervised
108108 training;
109109 (C) be clearly identified and commonly
110110 recognized throughout an industry;
111111 (D) involve manual, mechanical, or technical
112112 skills or knowledge which requires significant on-the-job work
113113 experience; and
114114 (E) require related instruction to supplement
115115 the on-the-job training;
116116 (2) standards of apprenticeship for particular
117117 trades; and
118118 (3) a process for and the criteria by which the
119119 commission may certify a training or apprenticeship program as an
120120 industry-recognized apprenticeship program, which must include:
121121 (A) a requirement that the training or program
122122 lead to employment in a high-wage, high-demand occupation; and
123123 (B) criteria generally consistent with the
124124 standards of apprenticeship as determined by the commission.
125125 SECTION 6. As soon as practicable after the effective date
126126 of this Act, the Texas Workforce Commission shall adopt the rules
127127 required by Chapter 133, Education Code, as amended by this Act.
128128 SECTION 7. This Act takes effect September 1, 2025.
