66 A BILL TO BE ENTITLED
77 AN ACT
88 relating to the power of a governmental entity to enforce
99 compliance with posted speed limits by an automated traffic control
1010 system.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. The heading to Section 542.2035, Transportation
1313 Code, is amended to read as follows:
1414 Sec. 542.2035. LIMITATION ON AUTOMATED TRAFFIC CONTROL
1515 SYSTEMS [MUNICIPALITIES].
1616 SECTION 2. Section 542.2035, Transportation Code, is
1717 amended by amending Subsection (a) and adding Subsection (c) to
1818 read as follows:
1919 (a) A governmental entity [municipality] may not implement
2020 or operate an automated traffic control system with respect to a
2121 highway or street under its jurisdiction for the purpose of
2222 enforcing compliance with posted speed limits. The attorney
2323 general shall enforce this subsection.
2424 (c) In this section, "governmental entity" means this state
2525 or a political subdivision of this state, including a municipality,
2626 a county or any kind of district.
2727 SECTION 3. This Act takes effect September 1, 2025.
