11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. The heading to Section 542.2035, Transportation | |
13 | 13 | Code, is amended to read as follows: | |
14 | 14 | Sec. 542.2035. LIMITATION ON AUTOMATED TRAFFIC CONTROL | |
15 | 15 | SYSTEMS [MUNICIPALITIES]. | |
16 | 16 | SECTION 2. Section 542.2035, Transportation Code, is | |
17 | 17 | amended by amending Subsection (a) and adding Subsection (c) to | |
18 | 18 | read as follows: | |
19 | 19 | (a) A governmental entity [municipality] may not implement | |
20 | 20 | or operate an automated traffic control system with respect to a | |
21 | 21 | highway or street under its jurisdiction for the purpose of | |
22 | 22 | enforcing compliance with posted speed limits. The attorney | |
23 | 23 | general shall enforce this subsection. | |
24 | 24 | (c) In this section, "governmental entity" means this state | |
25 | 25 | or a political subdivision of this state, including a municipality, | |
26 | 26 | a county or any kind of district. | |
27 | 27 | SECTION 3. This Act takes effect September 1, 2025. |
