77 AN ACT
88 relating to the licensing and regulation of outpatient behavioral
99 health centers; authorizing civil and administrative penalties;
1010 imposing fees.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subtitle C, Title 7, Health and Safety Code, is
1313 amended by adding Chapter 577B to read as follows:
1414 CHAPTER 577B. OUTPATIENT BEHAVIORAL HEALTH CENTERS
1515 SUBCHAPTER A. GENERAL PROVISIONS
1616 Sec. 577B.001. DEFINITIONS. In this chapter:
1717 (1) "Commission" means the Health and Human Services
1818 Commission.
1919 (2) "Outpatient behavioral health center" means a
2020 private facility that provides partial hospitalization services or
2121 intensive outpatient mental health services for persons with
2222 substance use disorders or who are experiencing mental illness.
2323 Sec. 577B.002. EXEMPTIONS. This chapter does not apply to:
2424 (1) a mental hospital;
2525 (2) a private mental hospital or other mental health
2626 facility licensed under Chapter 577; or
2727 (3) a psychiatric residential youth treatment
2828 facility certified under Chapter 577A.
2929 Sec. 577B.003. RULES. The executive commissioner shall
3030 adopt rules necessary to implement this chapter.
3131 SUBCHAPTER B. LICENSING, FEES, AND INSPECTIONS
3232 Sec. 577B.051. LICENSE REQUIRED. A person may not operate
3333 an outpatient behavioral health center without a license issued by
3434 the commission under this chapter.
3535 Sec. 577B.052. LICENSE APPLICATION. (a) An applicant for a
3636 license under this chapter must submit a sworn application to the
3737 commission on a form prescribed by the commission.
3838 (b) The commission shall prepare the application form and
3939 make the form available on request.
4040 (c) The application must be accompanied by a nonrefundable
4141 application fee and by a license fee. The commission shall return
4242 the license fee if the application is denied.
4343 (d) The application must contain:
4444 (1) the name and location of the outpatient behavioral
4545 health center;
4646 (2) the name and address of the physician to be in
4747 charge of the treatment of patients;
4848 (3) the name and address of the outpatient behavioral
4949 health center owners, including the officers, directors, and
5050 principal stockholders if the owner is a corporation or other
5151 association;
5252 (4) the number, duties, and qualifications of the
5353 professional staff;
5454 (5) a description of the equipment and facilities of
5555 the outpatient behavioral health center; and
5656 (6) other information required by the commission,
5757 including affirmative evidence of ability to comply with the
5858 commission's rules and standards.
5959 (e) The applicant must submit a plan of the outpatient
6060 behavioral health center premises that describes the buildings and
6161 grounds and the manner in which the various parts of the premises
6262 are intended to be used.
6363 (f) Subsection (e) does not apply to an application
6464 submitted for an outpatient behavioral health center that is in
6565 operation on September 1, 2025. This subsection expires September
6666 1, 2026.
6767 Sec. 577B.053. INVESTIGATION. The commission shall conduct
6868 an investigation as considered necessary after receiving the
6969 completed license application and the required fees.
7070 Sec. 577B.054. ISSUANCE AND RENEWAL OF LICENSE. (a) The
7171 commission shall issue a license if the commission finds that the
7272 premises are suitable and that the applicant is qualified to
7373 operate an outpatient behavioral health center, in accordance with
7474 the requirements and standards prescribed by law and the
7575 commission.
7676 (b) A license issued to the applicant under this chapter:
7777 (1) is valid only for the premises described by the
7878 license; and
7979 (2) is not transferable or assignable.
8080 (c) A license issued under this chapter expires on the
8181 second anniversary of the date the license is issued or renewed.
8282 (d) The commission shall renew a license if:
8383 (1) the license holder submits to the commission a fee
8484 established by the executive commissioner under Section 577B.055;
8585 and
8686 (2) on inspection and investigation the commission
8787 determines the license holder meets the requirements of this
8888 chapter and commission rules.
8989 Sec. 577B.055. FEES. (a) The executive commissioner by
9090 rule shall adopt fees for the application for a license and for the
9191 renewal of a license in amounts reasonable and necessary to cover
9292 the cost of administering this chapter.
9393 (b) All fees collected under this chapter shall be deposited
9494 to the credit of the general revenue fund.
9595 SUBCHAPTER C. REGULATION OF OUTPATIENT BEHAVIORAL HEALTH CENTERS
9696 Sec. 577B.101. MINIMUM STANDARDS. The executive
9797 commissioner shall adopt minimum standards to ensure proper care
9898 and treatment of patients in an outpatient behavioral health
9999 center.
100100 SUBCHAPTER D. ENFORCEMENT
101101 Sec. 577B.151. PENALTIES. A facility licensed under this
102102 chapter is subject to a civil penalty under Section 571.023 or an
103103 administrative penalty under Section 571.025, as applicable, for a
104104 violation of this chapter or a rule adopted under this chapter.
105105 SECTION 2. Section 577.002(b), Health and Safety Code, is
106106 amended to read as follows:
107107 (b) This chapter does not apply to:
108108 (1) a psychiatric residential youth treatment
109109 facility certified under Chapter 577A; or
110110 (2) an outpatient behavioral health center licensed
111111 under Chapter 577B.
112112 SECTION 3. Section 577A.002, Health and Safety Code, is
113113 amended to read as follows:
114114 Sec. 577A.002. EXEMPTIONS. This chapter does not apply to:
115115 (1) a mental hospital; [or]
116116 (2) a private mental hospital or other mental health
117117 facility licensed under Chapter 577; or
118118 (3) an outpatient behavioral health center licensed
119119 under Chapter 577B.
120120 SECTION 4. (a) As soon as practicable after the effective
121121 date of this Act, the executive commissioner of the Health and Human
122122 Services Commission shall adopt rules necessary to implement
123123 Chapter 577B, Health and Safety Code, as added by this Act.
124124 (b) Notwithstanding Chapter 577B, Health and Safety Code,
125125 as added by this Act, an outpatient behavioral health center
126126 described by that chapter is not required to be licensed under that
127127 chapter until September 1, 2026.
128128 SECTION 5. This Act takes effect September 1, 2025.
