11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Subchapter C, Chapter 391, Transportation Code, |
---|
13 | 13 | | is amended by adding Section 391.0685 to read as follows: |
---|
14 | 14 | | Sec. 391.0685. AUTHORIZED RENEWAL OF EXPIRED PERMIT. |
---|
15 | 15 | | (a) Notwithstanding any other provision of this subchapter, a |
---|
16 | 16 | | person who does not have actual knowledge of the necessity of |
---|
17 | 17 | | renewing a permit issued under Section 391.068(a) may renew the |
---|
18 | 18 | | permit until the seventh anniversary of the date of the permit's |
---|
19 | 19 | | expiration if the person submits to the commission: |
---|
20 | 20 | | (1) all fees associated with the permit that accrued |
---|
21 | 21 | | during the period of the permit's expiration, including any renewal |
---|
22 | 22 | | fee required for the permit; |
---|
23 | 23 | | (2) an additional late renewal fee in an amount |
---|
24 | 24 | | prescribed by commission rule; and |
---|
25 | 25 | | (3) an affidavit indicating that the person did not |
---|
26 | 26 | | have actual knowledge of the permit renewal requirements under this |
---|
27 | 27 | | subchapter. |
---|
28 | 28 | | (b) A person that complies with the requirements of |
---|
29 | 29 | | Subsection (a) is considered to possess the permit as though the |
---|
30 | 30 | | permit never expired and may not be penalized for violating any |
---|
31 | 31 | | provision of this subchapter relating to the previously expired |
---|
32 | 32 | | permit. |
---|
33 | 33 | | SECTION 2. Section 394.023, Transportation Code, is amended |
---|
34 | 34 | | to read as follows: |
---|
35 | 35 | | Sec. 394.023. TIME OF PERMIT; AUTHORIZED RENEWAL OF EXPIRED |
---|
36 | 36 | | PERMIT. (a) A permit is valid for one year. |
---|
37 | 37 | | (b) Notwithstanding any other provision of this chapter, a |
---|
38 | 38 | | person who does not have actual knowledge of the necessity of |
---|
39 | 39 | | renewing a permit may renew the permit until the seventh |
---|
40 | 40 | | anniversary of the date of the permit's expiration if the person |
---|
41 | 41 | | submits to the commission: |
---|
42 | 42 | | (1) all fees associated with the permit that accrued |
