88 AN ACT
99 relating to certain outdoor signs regulated by the Texas Department
1010 of Transportation.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter C, Chapter 391, Transportation Code,
1313 is amended by adding Section 391.0685 to read as follows:
1414 Sec. 391.0685. AUTHORIZED RENEWAL OF EXPIRED PERMIT.
1515 (a) Notwithstanding any other provision of this subchapter, a
1616 person who does not have actual knowledge of the necessity of
1717 renewing a permit issued under Section 391.068(a) may renew the
1818 permit until the seventh anniversary of the date of the permit's
1919 expiration if the person submits to the commission:
2020 (1) all fees associated with the permit that accrued
2121 during the period of the permit's expiration, including any renewal
2222 fee required for the permit;
2323 (2) an additional late renewal fee in an amount
2424 prescribed by commission rule; and
2525 (3) an affidavit indicating that the person did not
2626 have actual knowledge of the permit renewal requirements under this
2727 subchapter.
2828 (b) A person that complies with the requirements of
2929 Subsection (a) is considered to possess the permit as though the
3030 permit never expired and may not be penalized for violating any
3131 provision of this subchapter relating to the previously expired
3232 permit.
3333 SECTION 2. Section 394.023, Transportation Code, is amended
3434 to read as follows:
3535 Sec. 394.023. TIME OF PERMIT; AUTHORIZED RENEWAL OF EXPIRED
3636 PERMIT. (a) A permit is valid for one year.
3737 (b) Notwithstanding any other provision of this chapter, a
3838 person who does not have actual knowledge of the necessity of
3939 renewing a permit may renew the permit until the seventh
4040 anniversary of the date of the permit's expiration if the person
4141 submits to the commission:
4242 (1) all fees associated with the permit that accrued
4343 during the period of the permit's expiration, including any renewal
4444 fee required for the permit;
4545 (2) an additional late renewal fee in an amount
4646 prescribed by commission rule; and
4747 (3) an affidavit indicating that the person did not
4848 have actual knowledge of the permit renewal requirements under this
4949 chapter.
5050 (c) A person that complies with the requirements of
5151 Subsection (b) is considered to possess the permit as though the
5252 permit never expired and may not be penalized for violating any
5353 provision of this chapter relating to the previously expired
5454 permit.
5555 SECTION 3. This Act takes effect September 1, 2025.
