| 11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 12 | 12 | SECTION 1. Section 621.101, Transportation Code, is amended | |
| 13 | 13 | by adding Subsection (b-2) to read as follows: | |
| 14 | 14 | (b-2) Notwithstanding Subsections (a)(1) and (2), a vehicle | |
| 15 | 15 | or combination of vehicles that is transporting aggregates, as | |
| 16 | 16 | defined by Section 28A.001, Water Code, over a highway or road of | |
| 17 | 17 | this state may operate at an axle weight that is not heavier than | |
| 18 | 18 | the weight equal to the maximum allowable axle weight provided by | |
| 19 | 19 | those subsections plus a tolerance allowance of 15 percent of that | |
| 20 | 20 | allowable weight, provided that the gross weight of the vehicle or | |
| 21 | 21 | combination of vehicles is not heavier than the maximum gross | |
| 22 | 22 | weight authorized for the roadway on which the vehicle or | |
| 23 | 23 | combination of vehicles is being operated. | |
| 24 | 24 | SECTION 2. This Act takes effect immediately if it receives | |
| 25 | 25 | a vote of two-thirds of all the members elected to each house, as | |
| 26 | 26 | provided by Section 39, Article III, Texas Constitution. If this | |
| 27 | 27 | Act does not receive the vote necessary for immediate effect, this | |
| 28 | 28 | Act takes effect September 1, 2025. |
