| 9 | 9 | | relating to a report by the Legislative Budget Board on the reliance |

| 10 | 10 | | by this state on certain dedicated revenue for purposes of budget |
|---|
| 11 | 11 | | certification. |
|---|
| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 13 | 13 | | SECTION 1. Sections 322.024(a), (b), and (c), Government |
|---|
| 14 | 14 | | Code, are amended to read as follows: |
|---|
| 15 | 15 | | (a) In this section, "available dedicated revenue" means |
|---|
| 16 | 16 | | revenue that Section 403.095, including any reenactment of Section |
|---|
| 17 | 17 | | 403.095, makes available for certification under Section 403.121. |
|---|
| 18 | 18 | | (b) The board shall: |
|---|
| 19 | 19 | | (1) develop and implement a process to review: |
|---|
| 20 | 20 | | (A) new legislative enactments that create |
|---|
| 21 | 21 | | dedicated revenue; and |
|---|
| 22 | 22 | | (B) the appropriation and accumulation of |
|---|
| 23 | 23 | | dedicated revenue and available dedicated revenue; |
|---|
| 24 | 24 | | (2) develop and implement tools to evaluate the use of |
|---|
| 25 | 25 | | available dedicated revenue for state government financing and |
|---|
| 26 | 26 | | budgeting; and |
|---|
| 27 | 27 | | (3) develop specific and detailed recommendations on |
|---|
| 28 | 28 | | actions the legislature may reasonably take to reduce state |
|---|
| 29 | 29 | | government's reliance on available dedicated revenue for the |
|---|
| 30 | 30 | | purposes of certification under Section 403.121 as authorized by |
|---|
| 31 | 31 | | Section 403.095 or by any reenactment of Section 403.095. |
|---|
| 32 | 32 | | (c) The board shall: |
|---|
| 33 | 33 | | (1) incorporate into the board's budget |
|---|
| 34 | 34 | | recommendations for each state fiscal biennium appropriate |
|---|
| 35 | 35 | | measures to reduce state government's reliance on available |
|---|
| 36 | 36 | | dedicated revenue for the purposes of certification under Section |
|---|
| 37 | 37 | | 403.121 as authorized by Section 403.095 or by any reenactment of |
|---|
| 38 | 38 | | Section 403.095; and |
|---|
| 39 | 39 | | (2) [shall] include with the budget recommendations |
|---|
| 40 | 40 | | for each state fiscal biennium a plan adopted by the board [plans] |
|---|
| 41 | 41 | | for further reducing state government's reliance on available |
|---|
| 42 | 42 | | dedicated revenue for those purposes for the three state fiscal |
|---|
| 43 | 43 | | bienniums that follow the adoption of those budget recommendations |
|---|
| 44 | 44 | | [succeeding six years]. |
|---|
| 45 | 45 | | SECTION 2. This Act takes effect September 1, 2025. |
