77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to eligibility for tuition and fee exemptions at public
1010 institutions of higher education for certain students who were
1111 under the conservatorship of the Department of Family and
1212 Protective Services.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Section 54.366(a), Education Code, is amended to
1515 read as follows:
1616 (a) A student is exempt from the payment of tuition and fees
1717 authorized in this chapter, including tuition and fees charged by
1818 an institution of higher education for a dual credit course or other
1919 course for which a high school student may earn joint high school
2020 and college credit, if the student:
2121 (1) was under the conservatorship of the Department of
2222 Family and Protective Services:
2323 (A) on the day preceding the student's 18th
2424 birthday;
2525 (B) on or after the day of the student's 14th
2626 birthday, if the student was also eligible for adoption on or after
2727 that day;
2828 (C) on the day the student graduated from high
2929 school or received the equivalent of a high school diploma;
3030 (D) on the day preceding:
3131 (i) the date the student is adopted[, if
3232 that date is on or after September 1, 2009]; or
3333 (ii) the date permanent managing
3434 conservatorship of the student is awarded to a person other than the
3535 student's parent[, if that date is on or after September 1, 2009];
3636 or
3737 (E) during an academic term in which the student
3838 was enrolled in a dual credit course or other course for which a
3939 high school student may earn joint high school and college credit;
4040 and
4141 (2) enrolls in an institution of higher education as
4242 an undergraduate student or in a dual credit course or other course
4343 for which a high school student may earn joint high school and
4444 college credit not later than the student's 25th birthday.
4545 SECTION 2. The changes in law made by this Act to Section
4646 54.366, Education Code, apply beginning with tuition and fees
4747 charged for the 2025 fall semester. Tuition and fees charged for a
4848 term or semester before the 2025 fall semester are governed by the
4949 law in effect immediately before the effective date of this Act, and
5050 the former law is continued in effect for that purpose.
5151 SECTION 3. This Act takes effect immediately if it receives
5252 a vote of two-thirds of all the members elected to each house, as
5353 provided by Section 39, Article III, Texas Constitution. If this
5454 Act does not receive the vote necessary for immediate effect, this
5555 Act takes effect September 1, 2025.
