| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 271.003(8), Local Government Code, is |
|---|
| 13 | 13 | | amended to read as follows: |
|---|
| 14 | 14 | | (8) "Personal property" includes appliances, |
|---|
| 15 | 15 | | equipment, facilities, and furnishings, or an interest in personal |
|---|
| 16 | 16 | | property, whether movable or fixed, considered by the governing |
|---|
| 17 | 17 | | body of the governmental agency to be necessary, useful, or |
|---|
| 18 | 18 | | appropriate to one or more purposes of the governmental agency. The |
|---|
| 19 | 19 | | term includes all materials, consultation, assistance, and labor |
|---|
| 20 | 20 | | incident to the installation or use of that personal property. The |
|---|
| 21 | 21 | | term includes electricity and cloud computing services. The term |
|---|
| 22 | 22 | | does not include real property. |
|---|
| 23 | 23 | | SECTION 2. Section 271.005(b), Local Government Code, is |
|---|
| 24 | 24 | | amended to read as follows: |
|---|
| 25 | 25 | | (b) The governing body of a governmental agency may contract |
|---|
| 26 | 26 | | under this section for materials, consultation, assistance, and |
|---|
| 27 | 27 | | labor incident to the installation or use of personal property. |
|---|
| 28 | 28 | | SECTION 3. This Act takes effect September 1, 2025. |
