| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Chapter 120, Business & Commerce Code, is |
|---|
| 13 | 13 | | amended by adding Subchapter B-1 to read as follows: |
|---|
| 14 | 14 | | SUBCHAPTER B-1. PROVENANCE DATA |
|---|
| 15 | 15 | | Sec. 120.081. DEFINITION. In this subchapter, "provenance |
|---|
| 16 | 16 | | data" means metadata on a file that can be used to identify: |
|---|
| 17 | 17 | | (1) the date and place of the file's origin; |
|---|
| 18 | 18 | | (2) the method used to generate the file; or |
|---|
| 19 | 19 | | (3) the file's history, including the manner in which |
|---|
| 20 | 20 | | the file has been transmitted or stored. |
|---|
| 21 | 21 | | Sec. 120.082. APPLICABILITY OF SUBCHAPTER. (a) |
|---|
| 22 | 22 | | Notwithstanding Section 120.002(b), this subchapter applies only |
|---|
| 23 | 23 | | to a social media platform that functionally has more than 1.5 |
|---|
| 24 | 24 | | million active users in this state in a calendar month. |
|---|
| 25 | 25 | | (b) Notwithstanding Section 120.002(b), Subchapter D |
|---|
| 26 | 26 | | applies to a social media platform described by Subsection (a) for |
|---|
| 27 | 27 | | the purpose of enforcing this subchapter. |
|---|
| 28 | 28 | | Sec. 120.083. CONTENT CREATED ON SOCIAL MEDIA PLATFORM. |
|---|
| 29 | 29 | | (a) A social media platform shall attach provenance data to each |
|---|
| 30 | 30 | | photo, video, or audio file created on the social media platform or |
|---|
| 31 | 31 | | using tools provided by the social media platform. |
|---|
| 32 | 32 | | (b) A social media platform shall provide a method by which |
|---|
| 33 | 33 | | a user may easily access the provenance data of a photo, video, or |
|---|
| 34 | 34 | | audio file described by Subsection (a). |
|---|
| 35 | 35 | | Sec. 120.084. CONTENT POSTED TO SOCIAL MEDIA PLATFORM. (a) |
|---|
| 36 | 36 | | A social media platform shall attach provenance data to each photo, |
|---|
| 37 | 37 | | video, or audio file posted on the social media platform for which |
|---|
| 38 | 38 | | the social media platform can discern the file's provenance data. |
|---|
| 39 | 39 | | (b) If a social media platform cannot discern the provenance |
|---|
| 40 | 40 | | data of a photo, video, or audio file, the social media platform |
|---|
| 41 | 41 | | shall attach a notice to the file stating that the social media |
|---|
| 42 | 42 | | platform cannot discern the provenance data of the file. |
|---|
| 43 | 43 | | (c) A social media platform shall provide a method by which |
|---|
| 44 | 44 | | a user may easily access the provenance data of a photo, video, or |
|---|
| 45 | 45 | | audio file. The notice required by Subsection (b) must be displayed |
|---|
| 46 | 46 | | in place of provenance data, if a notice is attached to the file. |
|---|
| 47 | 47 | | SECTION 2. This Act takes effect September 1, 2025. |
