77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the justified use of force, including deadly force, by
1010 certain persons on certain residential property or manufactured
1111 home community property.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 82.002(c-1), Property Code, is amended
1414 to read as follows:
1515 (c-1) Sections [Section] 82.121 and 82.122 apply [applies]
1616 to a condominium for which the declaration was recorded before
1717 January 1, 1994.
1818 SECTION 2. Subchapter C, Chapter 82, Property Code, is
1919 amended by adding Section 82.122 to read as follows:
2020 Sec. 82.122. JUSTIFIED USE OF FORCE ON CONDOMINIUM
2121 PROPERTY. (a) An association or board may not levy a fine or
2222 otherwise take adverse action against a unit owner based on the use
2323 of force, including deadly force, that is justified under Chapter
2424 9, Penal Code, on condominium property by:
2525 (1) the unit owner;
2626 (2) a tenant or guest of the unit owner; or
2727 (3) a guest of a tenant of the unit owner.
2828 (b) For purposes of this section, there is an irrebuttable
2929 presumption that a person's use of force is justified if:
3030 (1) the person is found not guilty of each offense
3131 arising out of the use of force with which the person is charged;
3232 (2) a grand jury declines to indict the person for an
3333 offense arising out of the use of force; or
3434 (3) the prosecutor having jurisdiction to prosecute an
3535 offense arising out of the use of force declines to prosecute the
3636 person who used the force for an offense arising out of the use of
3737 force.
3838 (c) This section applies notwithstanding any provision of a
3939 dedicatory instrument to the contrary and regardless of the date of
4040 the provision's adoption.
4141 SECTION 3. Subchapter A, Chapter 92, Property Code, is
4242 amended by adding Section 92.027 to read as follows:
4343 Sec. 92.027. JUSTIFIED USE OF FORCE ON LEASED PREMISES. (a)
4444 A landlord may not evict or threaten to evict a tenant based on the
4545 use of force, including deadly force, that is justified under
4646 Chapter 9, Penal Code, on the premises by:
4747 (1) the tenant; or
4848 (2) a guest of the tenant.
4949 (b) For purposes of this section, there is an irrebuttable
5050 presumption that a person's use of force is justified if:
5151 (1) the person is found not guilty of each offense
5252 arising out of the use of force with which the person is charged;
5353 (2) a grand jury declines to indict the person for an
5454 offense arising out of the use of force; or
5555 (3) the prosecutor having jurisdiction to prosecute an
5656 offense arising out of the use of force declines to prosecute the
5757 person who used the force for an offense arising out of the use of
5858 force.
5959 SECTION 4. Subchapter F, Chapter 94, Property Code, is
6060 amended by adding Section 94.258 to read as follows:
6161 Sec. 94.258. JUSTIFIED USE OF FORCE ON LEASED PREMISES. (a)
6262 A landlord may not evict or threaten to evict a tenant based on the
6363 use of force, including deadly force, that is justified under
6464 Chapter 9, Penal Code, on the premises by:
6565 (1) the tenant; or
6666 (2) a guest of the tenant.
6767 (b) For purposes of this section, there is an irrebuttable
6868 presumption that a person's use of force is justified if:
6969 (1) the person is found not guilty of each offense
7070 arising out of the use of force with which the person is charged;
7171 (2) a grand jury declines to indict the person for an
7272 offense arising out of the use of force; or
7373 (3) the prosecutor having jurisdiction to prosecute an
7474 offense arising out of the use of force declines to prosecute the
7575 person who used the force for an offense arising out of the use of
7676 force.
7777 SECTION 5. Sections 92.027 and 94.258, Property Code, as
7878 added by this Act, do not affect the enforceability of a provision
7979 in a lease agreement entered into or renewed before the effective
8080 date of this Act.
8181 SECTION 6. This Act takes effect September 1, 2025.
