77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the enforcement of certain federal laws restricting the
1010 acquisition, manufacture, or possession of ammunition in this
1111 state.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 1.10, Penal Code, is amended by amending
1414 Subsections (b) and (c) and adding Subsection (c-1) to read as
1515 follows:
1616 (b) Notwithstanding any other law, an agency of this state,
1717 a political subdivision of this state, or a law enforcement officer
1818 or other person employed by an agency of this state or a political
1919 subdivision of this state may not contract with or in any other
2020 manner provide assistance to a federal agency or official with
2121 respect to the enforcement of a federal statute, order, rule, or
2222 regulation that:
2323 (1) imposes a prohibition, restriction, or other
2424 regulation that does not exist under the laws of this state; and
2525 (2) relates to:
2626 (A) a registry requirement for a firearm, a
2727 firearm accessory, or ammunition;
2828 (B) a requirement that an owner of a firearm, a
2929 firearm accessory, or ammunition possess a license as a condition
3030 of owning, possessing, or carrying the firearm, firearm accessory,
3131 or ammunition;
3232 (C) a requirement that a background check be
3333 conducted for the private sale or transfer of a firearm, a firearm
3434 accessory, or ammunition;
3535 (D) a program for confiscating a firearm, a
3636 firearm accessory, or ammunition from a person who is not otherwise
3737 prohibited by the laws of this state from possessing the firearm,
3838 firearm accessory, or ammunition; [or]
3939 (E) a program that requires an owner of a
4040 firearm, a firearm accessory, or ammunition to sell the firearm,
4141 firearm accessory, or ammunition;
4242 (F) a limitation on the amount of ammunition that
4343 may be purchased or otherwise obtained within a given period by a
4444 person who is not otherwise prohibited by the laws of this state
4545 from possessing the ammunition;
4646 (G) a requirement that a person obtaining
4747 ammunition display identification;
4848 (H) a limitation on the manufacture of ammunition
4949 by a person who is not otherwise prohibited by the laws of this
5050 state from possessing the ammunition; or
5151 (I) a limitation on the purchase, sale, transfer,
5252 or possession of components necessary to manufacture ammunition.
5353 (c) Subsections (b)(2)(A), (B), (C), (D), and (E) do
5454 [Subsection (b) does] not apply to a contract or agreement to
5555 provide assistance in the enforcement of a federal statute, order,
5656 rule, or regulation in effect on January 19, 2021.
5757 (c-1) Subsections (b)(2)(F), (G), (H), and (I) do not apply
5858 to a contract or agreement to provide assistance in the enforcement
5959 of a federal statute, order, rule, or regulation in effect on August
6060 31, 2025.
6161 SECTION 2. This Act takes effect September 1, 2025.
