| 9 | 9 | | relating to the enforcement of certain federal laws restricting the |
|---|
| 10 | 10 | | acquisition, manufacture, or possession of ammunition in this |
|---|
| 11 | 11 | | state. |
|---|
| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 13 | 13 | | SECTION 1. Section 1.10, Penal Code, is amended by amending |
|---|
| 14 | 14 | | Subsections (b) and (c) and adding Subsection (c-1) to read as |
|---|
| 15 | 15 | | follows: |
|---|
| 16 | 16 | | (b) Notwithstanding any other law, an agency of this state, |
|---|
| 17 | 17 | | a political subdivision of this state, or a law enforcement officer |
|---|
| 18 | 18 | | or other person employed by an agency of this state or a political |
|---|
| 19 | 19 | | subdivision of this state may not contract with or in any other |
|---|
| 20 | 20 | | manner provide assistance to a federal agency or official with |
|---|
| 21 | 21 | | respect to the enforcement of a federal statute, order, rule, or |
|---|
| 22 | 22 | | regulation that: |
|---|
| 23 | 23 | | (1) imposes a prohibition, restriction, or other |
|---|
| 24 | 24 | | regulation that does not exist under the laws of this state; and |
|---|
| 25 | 25 | | (2) relates to: |
|---|
| 26 | 26 | | (A) a registry requirement for a firearm, a |
|---|
| 27 | 27 | | firearm accessory, or ammunition; |
|---|
| 28 | 28 | | (B) a requirement that an owner of a firearm, a |
|---|
| 29 | 29 | | firearm accessory, or ammunition possess a license as a condition |
|---|
| 30 | 30 | | of owning, possessing, or carrying the firearm, firearm accessory, |
|---|
| 31 | 31 | | or ammunition; |
|---|
| 32 | 32 | | (C) a requirement that a background check be |
|---|
| 33 | 33 | | conducted for the private sale or transfer of a firearm, a firearm |
|---|
| 34 | 34 | | accessory, or ammunition; |
|---|
| 35 | 35 | | (D) a program for confiscating a firearm, a |
|---|
| 36 | 36 | | firearm accessory, or ammunition from a person who is not otherwise |
|---|
| 37 | 37 | | prohibited by the laws of this state from possessing the firearm, |
|---|
| 38 | 38 | | firearm accessory, or ammunition; [or] |
|---|
| 39 | 39 | | (E) a program that requires an owner of a |
|---|
| 40 | 40 | | firearm, a firearm accessory, or ammunition to sell the firearm, |
|---|
| 41 | 41 | | firearm accessory, or ammunition; |
|---|
| 42 | 42 | | (F) a limitation on the amount of ammunition that |
|---|
| 43 | 43 | | may be purchased or otherwise obtained within a given period by a |
|---|
| 44 | 44 | | person who is not otherwise prohibited by the laws of this state |
|---|
| 45 | 45 | | from possessing the ammunition; |
|---|
| 46 | 46 | | (G) a requirement that a person obtaining |
|---|
| 47 | 47 | | ammunition display identification; |
|---|
| 48 | 48 | | (H) a limitation on the manufacture of ammunition |
|---|
| 49 | 49 | | by a person who is not otherwise prohibited by the laws of this |
|---|
| 50 | 50 | | state from possessing the ammunition; or |
|---|
| 51 | 51 | | (I) a limitation on the purchase, sale, transfer, |
|---|
| 52 | 52 | | or possession of components necessary to manufacture ammunition. |
|---|
| 53 | 53 | | (c) Subsections (b)(2)(A), (B), (C), (D), and (E) do |
|---|
| 54 | 54 | | [Subsection (b) does] not apply to a contract or agreement to |
|---|
| 55 | 55 | | provide assistance in the enforcement of a federal statute, order, |
|---|
| 56 | 56 | | rule, or regulation in effect on January 19, 2021. |
|---|
| 57 | 57 | | (c-1) Subsections (b)(2)(F), (G), (H), and (I) do not apply |
|---|
| 58 | 58 | | to a contract or agreement to provide assistance in the enforcement |
|---|
| 59 | 59 | | of a federal statute, order, rule, or regulation in effect on August |
|---|
| 60 | 60 | | 31, 2025. |
|---|
| 61 | 61 | | SECTION 2. This Act takes effect September 1, 2025. |
