77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the definition of short-barrel firearm for purposes of
1010 certain criminal offenses.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 46.01, Penal Code, is amended by
1313 amending Subdivision (10) to read as follows:
1414 (10) "Short-barrel firearm" means a rifle with a
1515 barrel length of less than 16 inches or a shotgun with a barrel
1616 length of less than 18 inches, or any weapon made from a shotgun or
1717 rifle if, as altered, it has an overall length of less than 26
1818 inches. The term does not include a handgun equipped with a
1919 stabilizing brace designed to assist a person with handling the
2020 handgun with one hand.
2121 SECTION 2. The change in law made by this Act applies only
2222 to an offense committed on or after the effective date of this Act.
2323 An offense committed before the effective date of this Act is
2424 governed by the law in effect on the date the offense was committed,
2525 and the former law is continued in effect for that purpose. For
2626 purposes of this section, an offense was committed before the
2727 effective date of this Act if any element of the offense occurred
2828 before that date.
2929 SECTION 3. This Act takes effect September 1, 2025.
