| 12 | 12 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 13 | 13 | SECTION 1. Subchapter B, Chapter 501, Election Code, is | |
| 14 | 14 | amended by adding Section 501.0211 to read as follows: | |
| 15 | 15 | Sec. 501.0211. ELECTION CALLED BY GOVERNING BODY OF | |
| 16 | 16 | POLITICAL SUBDIVISION. (a) This section applies only to a county: | |
| 17 | 17 | (1) with a population of more than 70,000 and less than | |
| 18 | 18 | 100,000; | |
| 19 | 19 | (2) that contains a portion of the Colorado River; and | |
| 20 | 20 | (3) that is adjacent to a county with a population of | |
| 21 | 21 | one million or more. | |
| 22 | 22 | (b) The commissioners court of a county may, on the | |
| 23 | 23 | commissioners court's own motion, order a local option election in | |
| 24 | 24 | the county or a justice precinct in the county to determine whether | |
| 25 | 25 | the sale of alcoholic beverages of one or more of the various types | |
| 26 | 26 | and alcoholic contents shall be legalized in the county or the | |
| 27 | 27 | justice precinct. | |
| 28 | 28 | (c) The governing body of a municipality may, by resolution, | |
| 29 | 29 | order a local option election to be held in the municipality to | |
| 30 | 30 | determine whether the sale of alcoholic beverages of one or more of | |
| 31 | 31 | the various types and alcoholic contents shall be legalized in the | |
| 32 | 32 | municipality. | |
| 33 | 33 | SECTION 2. This Act takes effect September 1, 2025. |
