77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to allowing the governing bodies of certain political
1010 subdivisions to call for a local option election relating to the
1111 sale of alcoholic beverages.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter B, Chapter 501, Election Code, is
1414 amended by adding Section 501.0211 to read as follows:
1515 Sec. 501.0211. ELECTION CALLED BY GOVERNING BODY OF
1616 POLITICAL SUBDIVISION. (a) This section applies only to a county:
1717 (1) with a population of more than 70,000 and less than
1818 100,000;
1919 (2) that contains a portion of the Colorado River; and
2020 (3) that is adjacent to a county with a population of
2121 one million or more.
2222 (b) The commissioners court of a county may, on the
2323 commissioners court's own motion, order a local option election in
2424 the county or a justice precinct in the county to determine whether
2525 the sale of alcoholic beverages of one or more of the various types
2626 and alcoholic contents shall be legalized in the county or the
2727 justice precinct.
2828 (c) The governing body of a municipality may, by resolution,
2929 order a local option election to be held in the municipality to
3030 determine whether the sale of alcoholic beverages of one or more of
3131 the various types and alcoholic contents shall be legalized in the
3232 municipality.
3333 SECTION 2. This Act takes effect September 1, 2025.
