77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the right of a motorist who fails to hold a driver's
1010 license or maintain motor vehicle liability insurance or other
1111 financial responsibility for a motor vehicle to recover damages
1212 arising from a motor vehicle collision.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Chapter 72, Civil Practice and Remedies Code, is
1515 amended by adding Subchapter C to read as follows:
1616 SUBCHAPTER C. EFFECT OF CERTAIN VIOLATIONS INVOLVING OPERATION OF
1717 MOTOR VEHICLE
1818 Sec. 72.101. RIGHT OF CERTAIN MOTORISTS TO BRING ACTION FOR
1919 DAMAGES. An individual operating a motor vehicle in violation of
2020 Section 521.021 or 601.051, Transportation Code, may not bring a
2121 civil action against another motor vehicle operator or that
2222 operator's liability insurer for damages resulting from a collision
2323 involving the individual's motor vehicle.
2424 SECTION 2. Section 72.101, Civil Practice and Remedies
2525 Code, as added by this Act, applies only to an action filed on or
2626 after the effective date of this Act.
2727 SECTION 3. This Act takes effect immediately if it receives
2828 a vote of two-thirds of all the members elected to each house, as
2929 provided by Section 39, Article III, Texas Constitution. If this
3030 Act does not receive the vote necessary for immediate effect, this
3131 Act takes effect September 1, 2025.
