77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the imposition of administrative, civil, and criminal
1010 penalties for violating certain statutes under the jurisdiction of,
1111 rules or orders adopted by, or licenses, permits, or certificates
1212 issued by the Railroad Commission of Texas; increasing criminal
1313 penalties.
1414 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1515 SECTION 1. Sections 81.0531(b), (c), and (d), Natural
1616 Resources Code, are amended to read as follows:
1717 (b) The penalty may not exceed:
1818 (1) $25,000 [$10,000] a day for each violation that is
1919 not related to pipeline safety; or
2020 (2) $200,000 a day for each violation that is related
2121 to pipeline safety.
2222 (c) In determining the amount of the penalty, the commission
2323 shall consider the [permittee's history of previous violations, the
2424 seriousness of the violation, any hazard to the health or safety of
2525 the public, and the demonstrated good faith of the person charged.
2626 In determining the amount of the penalty for a violation of a
2727 provision of this title or a rule, order, license, permit, or
2828 certificate that relates to pipeline safety, the commission shall
2929 consider the] guidelines adopted under Subsection (d).
3030 (d) The commission [by rule] shall adopt guidelines to be
3131 used in determining the amount of the penalty. The commission shall
3232 provide an opportunity for public input on the guidelines [for a
3333 violation of a provision of this title or a rule, order, license,
3434 permit, or certificate that relates to pipeline safety]. The
3535 guidelines must [shall] include a penalty calculation worksheet
3636 that specifies the typical penalty for certain violations,
3737 circumstances justifying enhancement of a penalty and the amount of
3838 the enhancement, and circumstances justifying a reduction in a
3939 penalty and the amount of the reduction. The guidelines must
4040 provide for different penalties for different violations based on
4141 the seriousness of the violation and any hazard to the health or
4242 safety of the public resulting from the violation. The guidelines
4343 must [shall] take into account:
4444 (1) the permittee's history of previous violations,
4545 including the number of previous violations;
4646 (2) the seriousness of the violation and of any
4747 pollution resulting from the violation;
4848 (3) any hazard to the health or safety of the public;
4949 (4) the degree of culpability;
5050 (5) the demonstrated good faith of the person charged;
5151 [and]
5252 (6) the number of times the permittee's certificate of
5353 compliance issued under Subchapter P, Chapter 91, has been
5454 canceled;
5555 (7) any economic benefit gained through the violation;
5656 (8) the penalty necessary to deter future violations;
5757 and
5858 (9) any other factor the commission considers
5959 relevant.
6060 SECTION 2. Section 81.058(d), Natural Resources Code, is
6161 amended to read as follows:
6262 (d) An administrative penalty imposed under this section
6363 may not exceed $25,000 [$5,000] a day for each violation. Each day
6464 a violation continues or occurs is a separate violation for
6565 purposes of imposing a penalty under this section.
6666 SECTION 3. Section 91.002(b), Natural Resources Code, is
6767 amended to read as follows:
6868 (b) An offense under Subsection (a) [of this section] is
6969 punishable by a fine of not more than $25,000 [$10,000] a day for
7070 each day a violation is committed.
7171 SECTION 4. Section 27.101(a), Water Code, is amended to
7272 read as follows:
7373 (a) A person who violates any provision of this chapter
7474 under the jurisdiction of the railroad commission, any rule of the
7575 railroad commission made under this chapter, or any term,
7676 condition, or provision of a permit issued by the railroad
7777 commission under this chapter shall be subject to a civil penalty in
7878 any sum not exceeding $25,000 [$5,000] for each day of
7979 noncompliance and for each act of noncompliance. A violation under
8080 the jurisdiction of the commission is enforceable as provided by
8181 Chapter 7.
8282 SECTION 5. Section 27.1011(b), Water Code, is amended to
8383 read as follows:
8484 (b) The penalty may not exceed $25,000 [$10,000] a day for
8585 each violation. Each day a violation continues may be considered a
8686 separate violation for purposes of penalty assessments.
8787 SECTION 6. Section 27.105(a), Water Code, is amended to
8888 read as follows:
8989 (a) A person who knowingly or intentionally violates a
9090 provision of this chapter under the jurisdiction of the railroad
9191 commission, a rule of the railroad commission, or a term,
9292 condition, or provision of a permit issued by the railroad
9393 commission under this chapter is subject to a fine of not more than
9494 $25,000 [$5,000] for each violation and for each day of violation.
9595 A violation under the jurisdiction of the commission is enforceable
9696 under Section 7.157.
9797 SECTION 7. The changes in law made by this Act apply only to
9898 a violation committed on or after the effective date of this Act. A
9999 violation committed before the effective date of this Act is
100100 governed by the law in effect when the violation was committed, and
101101 the former law is continued in effect for that purpose. For
102102 purposes of this section, a violation was committed before the
103103 effective date of this Act if any element of the violation was
104104 committed before that date.
105105 SECTION 8. This Act takes effect September 1, 2025.
