77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the maximum amount of a security deposit for a
1010 residential lease.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 92.102, Property Code, is amended to
1313 read as follows:
1414 Sec. 92.102. SECURITY DEPOSIT. (a) A security deposit is
1515 any advance of money, other than a rental application deposit or an
1616 advance payment of rent, that is intended primarily to secure
1717 performance under a lease of a dwelling that has been entered into
1818 by a landlord and a tenant.
1919 (b) A security deposit may not exceed the amount of one
2020 month's rent for the dwelling.
2121 SECTION 2. Section 92.102, Property Code, as amended by
2222 this Act, applies only to a lease entered into or renewed on or
2323 after the effective date of this Act. A lease entered into or
2424 renewed before the effective date of this Act is governed by the law
2525 as it existed immediately before the effective date of this Act, and
2626 that law is continued in effect for that purpose.
2727 SECTION 3. This Act takes effect September 1, 2025.
