11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Section 92.102, Property Code, is amended to | |
13 | 13 | read as follows: | |
14 | 14 | Sec. 92.102. SECURITY DEPOSIT. (a) A security deposit is | |
15 | 15 | any advance of money, other than a rental application deposit or an | |
16 | 16 | advance payment of rent, that is intended primarily to secure | |
17 | 17 | performance under a lease of a dwelling that has been entered into | |
18 | 18 | by a landlord and a tenant. | |
19 | 19 | (b) A security deposit may not exceed the amount of one | |
20 | 20 | month's rent for the dwelling. | |
21 | 21 | SECTION 2. Section 92.102, Property Code, as amended by | |
22 | 22 | this Act, applies only to a lease entered into or renewed on or | |
23 | 23 | after the effective date of this Act. A lease entered into or | |
24 | 24 | renewed before the effective date of this Act is governed by the law | |
25 | 25 | as it existed immediately before the effective date of this Act, and | |
26 | 26 | that law is continued in effect for that purpose. | |
27 | 27 | SECTION 3. This Act takes effect September 1, 2025. |
