77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to rental application fees; providing an administrative
1010 penalty.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter I, Chapter 92, Property Code, is
1313 amended by adding Section 92.356 to read as follows:
1414 Sec. 92.356. APARTMENT COMPLEX APPLICATION FEES. (a) In
1515 this section:
1616 (1) "Apartment complex" means five or more dwellings
1717 in one or more buildings that are owned by the same owner, located
1818 on the same lot or tract, and managed by the same owner, agent, or
1919 management company.
2020 (2) "Commission" means the Texas Workforce
2121 Commission.
2222 (b) A landlord of an apartment complex or the landlord's
2323 manager or agent may not charge an application fee to an applicant
2424 in an amount greater than the reasonable costs of processing the
2525 applicant's rental application and screening the applicant's
2626 eligibility according to the landlord's tenant selection criteria
2727 made available under Section 92.3515.
2828 (c) A landlord of an apartment complex or the landlord's
2929 manager or agent that charges an application fee shall:
3030 (1) file with the commission a detailed disclosure of
3131 the fee, including the costs of processing the rental application,
3232 screening an applicant, and any other costs; and
3333 (2) at the time an applicant is provided with a rental
3434 application and before accepting an application fee, provide to the
3535 applicant the detailed disclosure of the fee described by
3636 Subdivision (1).
3737 (d) If the commission finds that a landlord of an apartment
3838 complex or the landlord's manager or agent has violated this
3939 section, the commission may assess an administrative penalty of:
4040 (1) $1,000 for a first violation; and
4141 (2) $2,000 for a second or subsequent violation.
4242 SECTION 2. The changes in law made by this Act apply only to
4343 an application fee charged on or after the effective date of this
4444 Act.
4545 SECTION 3. This Act takes effect September 1, 2025.
