88 AN ACT
99 relating to training for peace officers on interacting with persons
1010 with autism spectrum disorder.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 1701.253, Occupations Code, is amended
1313 by adding Subsection (u) to read as follows:
1414 (u) As part of the minimum curriculum requirements, the
1515 commission shall require an officer to complete the training
1616 program established under Section 1701.273.
1717 SECTION 2. Subchapter F, Chapter 1701, Occupations Code, is
1818 amended by adding Section 1701.273 to read as follows:
1919 Sec. 1701.273. TRAINING PROGRAM ON INTERACTING WITH PERSONS
2020 WITH AUTISM SPECTRUM DISORDER. (a) In this section, "autism
2121 spectrum disorder" means:
2222 (1) a neurobiological disorder or developmental
2323 disability that significantly affects verbal communication,
2424 nonverbal communication, and social interaction and that meets the
2525 diagnostic criteria for autism spectrum disorder specified by the
2626 Diagnostic and Statistical Manual of Mental Disorders, 5th Edition,
2727 or a later edition; or
2828 (2) a diagnosis made using a previous edition of the
2929 Diagnostic and Statistical Manual of Mental Disorders of autism,
3030 Asperger's syndrome, or Pervasive Developmental Disorder--Not
3131 Otherwise Specified.
3232 (b) The commission by rule shall establish and maintain a
3333 training program for officers on interacting with a person with
3434 autism spectrum disorder.
3535 (c) The training program must be not less than two hours.
3636 (d) The training program must be evidence-based and include
3737 the following topics:
3838 (1) understanding the nature of autism spectrum
3939 disorder and the differing manifestations of the disorder in a
4040 person, including:
4141 (A) identifying a person with autism spectrum
4242 disorder and differentiating that person from another person who
4343 does not have the disorder and who may be uncooperative or intending
4444 to commit a criminal offense;
4545 (B) knowing how age, gender, and ethnicity affect
4646 a person with autism spectrum disorder; and
4747 (C) understanding the relationship between
4848 autism spectrum disorder and criminal or otherwise antisocial
4949 behavior;
5050 (2) effectively communicating with a person with
5151 autism spectrum disorder, including best practices on:
5252 (A) communicating without causing the person
5353 unnecessary stress;
5454 (B) interviewing and interrogating the person;
5555 and
5656 (C) de-escalating an interaction with the
5757 person;
5858 (3) locating a person with autism spectrum disorder
5959 who has run away and may be in danger;
6060 (4) recognizing the circumstances under which a person
6161 with autism spectrum disorder may be abused, coerced, or criminally
6262 exploited, including radicalization of the person;
6363 (5) ensuring the safety of a person with autism
6464 spectrum disorder who is confined in a correctional facility; and
6565 (6) understanding the laws on taking a person into
6666 custody and applying for emergency detention under Subtitle C,
6767 Title 7, Health and Safety Code.
6868 SECTION 3. As soon as practicable after the effective date
6969 of this Act, the Texas Commission on Law Enforcement shall adopt
7070 rules necessary to implement the changes in law made by this Act.
7171 SECTION 4. The minimum curriculum requirements under
7272 Section 1701.253(u), Occupations Code, as added by this Act, apply
7373 only to an officer who first begins to satisfy those requirements on
7474 or after January 1, 2026.
7575 SECTION 5. This Act takes effect September 1, 2025.
