77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the restoration of civil rights to a criminal
1010 defendant.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Article 48.05(a)(2), Code of Criminal Procedure,
1313 is amended to read as follows:
1414 (2) This article applies to:
1515 (A) a federal offense, other than an offense
1616 involving:
1717 (i) violence or the threat of violence;
1818 (ii) drugs; or
1919 (iii) firearms; [and]
2020 (B) an offense under the laws of another country,
2121 other than an offense involving:
2222 (i) violence or the threat of violence;
2323 (ii) drugs; or
2424 (iii) firearms, if the elements of the
2525 offense are substantially similar to elements of an offense under
2626 the laws of this state punishable as a felony; and
2727 (C) an offense under the laws of this state,
2828 other than an offense involving:
2929 (i) violence or the threat of violence;
3030 (ii) drugs; or
3131 (iii) firearms, if the offense is
3232 punishable as a felony.
3333 SECTION 2. Article 48.05(b), Code of Criminal Procedure, is
3434 amended to read as follows:
3535 (b) An individual may not apply for restoration of civil
3636 rights under this article unless:
3737 (1) the individual has completed the sentence for the
3838 offense; and
3939 (2) the conviction occurred[:
4040 [(A)] three or more years before the date of
4141 application[, if the offense is a federal offense; or
4242 [(B) two or more years before the date of
4343 application, if the offense is an offense under the laws of another
4444 country; and
4545 [(3) the individual has not been convicted at any
4646 other time of an offense under the laws of this state, another
4747 state, or the United States].
4848 SECTION 3. This Act applies to a defendant who is convicted
4949 of an offense before, on, or after the effective date of this Act.
5050 SECTION 4. This Act takes effect September 1, 2025.
