77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to egg grading and the selling of ungraded eggs.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 132.002, Agriculture Code, is amended to
1212 read as follows:
1313 Sec. 132.002. SALE OF UNGRADED EGGS BY PRODUCER [LIMITATION
1414 OF CHAPTER]. (a) Except as provided by this section, this [This]
1515 chapter does not apply to a person selling only eggs that are
1616 produced by the person's own flock and for which the person does not
1717 claim a grade.
1818 (b) A person who produces eggs as described by Subsection
1919 (a) may sell up to 120 dozen ungraded eggs per week directly to
2020 consumers or, subject to Subsections (d) and (e), at wholesale.
2121 (c) A person who sells ungraded eggs as provided by
2222 Subsection (b) shall label the cartons of eggs with a label that:
2323 (1) is legible;
2424 (2) appears on the top panel of the carton; and
2525 (3) contains:
2626 (A) the word "ungraded";
2727 (B) the producer's name;
2828 (C) the producer's address;
2929 (D) the producer's license number under
3030 Subsection (d), if the eggs are sold or offered for sale at
3131 wholesale; and
3232 (E) the date the carton was packed.
3333 (d) A person who produces eggs as described by Subsection
3434 (a) may not sell the eggs at wholesale unless the person holds a
3535 license as an ungraded dealer-wholesaler issued by the department.
3636 (e) A person who sells eggs as described by Subsection (d)
3737 shall:
3838 (1) maintain records as provided by Section 132.061;
3939 and
4040 (2) follow the sanitation requirements of Section
4141 132.045 when handling eggs sold or offered for sale at wholesale.
4242 SECTION 2. This Act takes effect immediately if it receives
4343 a vote of two-thirds of all the members elected to each house, as
4444 provided by Section 39, Article III, Texas Constitution. If this
4545 Act does not receive the vote necessary for immediate effect, this
4646 Act takes effect September 1, 2025.
