| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 545.060(a), Transportation Code, is |
|---|
| 13 | 13 | | amended to read as follows: |
|---|
| 14 | 14 | | (a) An operator on a roadway divided into two or more |
|---|
| 15 | 15 | | clearly marked lanes for traffic: |
|---|
| 16 | 16 | | (1) shall drive as nearly as practical entirely within |
|---|
| 17 | 17 | | a single lane, except as provided by Section 545.0605; and |
|---|
| 18 | 18 | | (2) may not move from the lane unless that movement can |
|---|
| 19 | 19 | | be made safely. |
|---|
| 20 | 20 | | SECTION 2. Section 545.0605, Transportation Code, is |
|---|
| 21 | 21 | | amended by amending Subsection (a) and adding Subsection (c) to |
|---|
| 22 | 22 | | read as follows: |
|---|
| 23 | 23 | | (a) The operator of a motorcycle: |
|---|
| 24 | 24 | | (1) is entitled to full use of a lane and, except as |
|---|
| 25 | 25 | | otherwise provided by Subdivision (2), a motor vehicle may not be |
|---|
| 26 | 26 | | driven in a manner that deprives a motorcycle of the full use of a |
|---|
| 27 | 27 | | lane; |
|---|
| 28 | 28 | | (2) may: |
|---|
| 29 | 29 | | (A) operate the motorcycle: |
|---|
| 30 | 30 | | (i) two abreast in a single lane with |
|---|
| 31 | 31 | | another motorcycle; or |
|---|
| 32 | 32 | | (ii) for a safe distance between lanes of |
|---|
| 33 | 33 | | traffic moving in the same direction; or |
|---|
| 34 | 34 | | (B) pass a motor vehicle while in the same lane as |
|---|
| 35 | 35 | | the vehicle being passed only if: |
|---|
| 36 | 36 | | (i) the operator is on a divided highway |
|---|
| 37 | 37 | | with at least two lanes of traffic in each direction; |
|---|
| 38 | 38 | | (ii) the vehicle being passed is stopped or |
|---|
| 39 | 39 | | moving at a speed of not more than 10 miles per hour; |
|---|
| 40 | 40 | | (iii) the motorcycle is operated at a speed |
|---|
| 41 | 41 | | of not more than 20 miles per hour when making the pass; and |
|---|
| 42 | 42 | | (iv) the pass can be made safely; and |
|---|
| 43 | 43 | | (3) may not[; |
|---|
| 44 | 44 | | [(A)] operate the motorcycle more than two |
|---|
| 45 | 45 | | abreast in a single lane with other motorcycles[; |
|---|
| 46 | 46 | | [(B) operate the motorcycle between lanes of |
|---|
| 47 | 47 | | traffic moving in the same direction; or |
|---|
| 48 | 48 | | [(C) pass a motor vehicle while in the same lane |
|---|
| 49 | 49 | | as the vehicle being passed]. |
|---|
| 50 | 50 | | (c) Subsection (a) does not authorize the operator of a |
|---|
| 51 | 51 | | motorcycle to pass a school bus in a manner prohibited by Section |
|---|
| 52 | 52 | | 545.066. |
|---|
| 53 | 53 | | SECTION 3. This Act takes effect September 1, 2025. |
