77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to access under the public information law to certain
1010 information held by a law enforcement agency or prosecutor.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 552.108(d), Government Code, as added by
1313 Chapter 986 (H.B. 30), Acts of the 88th Legislature, Regular
1414 Session, 2023, is redesignated as Section 552.108(c-1), Government
1515 Code, and amended to read as follows:
1616 (c-1) [(d)] The exceptions [exception] to disclosure
1717 provided by Subsections [Subsection] (a)(2) and (b)(2) do [does]
1818 not apply to information, records, or notations if:
1919 (1) a person who is described by or depicted in the
2020 information, record, or notation, other than a peace officer, is
2121 deceased or incapacitated; or
2222 (2) each person who is described by or depicted in the
2323 information, record, or notation, other than a person who is
2424 deceased or incapacitated, consents to the release of the
2525 information, record, or notation.
2626 SECTION 2. The changes in law made by this Act to Section
2727 552.108, Government Code, apply only to a request for information
2828 that is received by a governmental body or an officer or employee of
2929 a governmental body on or after the effective date of this Act. A
3030 request for information that was received before the effective date
3131 of this Act is governed by the law in effect on the date the request
3232 was received, and the former law is continued in effect for that
3333 purpose.
3434 SECTION 3. To the extent of any conflict, this Act prevails
3535 over another Act of the 89th Legislature, Regular Session, 2025,
3636 relating to nonsubstantive additions to and corrections in enacted
3737 codes.
3838 SECTION 4. This Act takes effect September 1, 2025.
