| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 552.108(d), Government Code, as added by |
|---|
| 13 | 13 | | Chapter 986 (H.B. 30), Acts of the 88th Legislature, Regular |
|---|
| 14 | 14 | | Session, 2023, is redesignated as Section 552.108(c-1), Government |
|---|
| 15 | 15 | | Code, and amended to read as follows: |
|---|
| 16 | 16 | | (c-1) [(d)] The exceptions [exception] to disclosure |
|---|
| 17 | 17 | | provided by Subsections [Subsection] (a)(2) and (b)(2) do [does] |
|---|
| 18 | 18 | | not apply to information, records, or notations if: |
|---|
| 19 | 19 | | (1) a person who is described by or depicted in the |
|---|
| 20 | 20 | | information, record, or notation, other than a peace officer, is |
|---|
| 21 | 21 | | deceased or incapacitated; or |
|---|
| 22 | 22 | | (2) each person who is described by or depicted in the |
|---|
| 23 | 23 | | information, record, or notation, other than a person who is |
|---|
| 24 | 24 | | deceased or incapacitated, consents to the release of the |
|---|
| 25 | 25 | | information, record, or notation. |

| 26 | 26 | | SECTION 2. The changes in law made by this Act to Section |
|---|
| 27 | 27 | | 552.108, Government Code, apply only to a request for information |
|---|
| 28 | 28 | | that is received by a governmental body or an officer or employee of |
|---|
| 29 | 29 | | a governmental body on or after the effective date of this Act. A |
|---|
| 30 | 30 | | request for information that was received before the effective date |
|---|
| 31 | 31 | | of this Act is governed by the law in effect on the date the request |
|---|
| 32 | 32 | | was received, and the former law is continued in effect for that |
|---|
| 33 | 33 | | purpose. |
|---|
| 34 | 34 | | SECTION 3. To the extent of any conflict, this Act prevails |
|---|
| 35 | 35 | | over another Act of the 89th Legislature, Regular Session, 2025, |
|---|
| 36 | 36 | | relating to nonsubstantive additions to and corrections in enacted |
|---|
| 37 | 37 | | codes. |
|---|
| 38 | 38 | | SECTION 4. This Act takes effect September 1, 2025. |
