77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to vision screenings for students in public or private
1010 school, including vision screening information reporting for
1111 public school students and the creation of a vision care allotment
1212 under the Foundation School Program.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Subchapter A, Chapter 38, Education Code, is
1515 amended by adding Section 38.035 to read as follows:
1616 Sec. 38.035. VISION SCREENING REPORTING. (a) Not later
1717 than May 31 of each year, the agency shall post on the agency's
1818 Internet website a report regarding the number of students in each
1919 school district identified as having a vision disorder or other
2020 vision problem requiring vision care under the screening program
2121 described by Section 36.004, Health and Safety Code, disaggregated
2222 by:
2323 (1) grade level;
2424 (2) campus;
2525 (3) gender;
2626 (4) race;
2727 (5) ethnicity;
2828 (6) whether the student is educationally
2929 disadvantaged; and
3030 (7) the number of times the student has previously
3131 been identified as having a vision disorder or other vision problem
3232 requiring vision care.
3333 (b) The commissioner by rule shall require each school
3434 district to report through the Public Education Information
3535 Management System (PEIMS) information necessary for the agency to
3636 prepare the report required by this section.
3737 SECTION 2. Subchapter C, Chapter 48, Education Code, is
3838 amended by adding Section 48.1035 to read as follows:
3939 Sec. 48.1035. ALLOTMENT FOR VISION CARE FOR CERTAIN
4040 STUDENTS. (a) In this section:
4141 (1) "Eligible student" means a student who:
4242 (A) has been identified as having a vision
4343 disorder or other vision problem requiring vision care under the
4444 screening program described by Section 36.004, Health and Safety
4545 Code; and
4646 (B) is educationally disadvantaged.
4747 (2) "Vision care" includes eye exams and assistive or
4848 corrective visual devices, including glasses or contact lenses.
4949 (b) A school district is entitled to an annual allotment
5050 equal to $75 or a greater amount provided by appropriation for each
5151 eligible student in average daily attendance.
5252 (c) Funds allocated under this section must be used to pay
5353 for costs associated with providing vision care to eligible
5454 students, which may include reimbursing the parent of an eligible
5555 student for vision care provided to that student.
5656 (d) Funds allocated under this section may not be used to
5757 supplant any other funds provided for the same purpose.
5858 SECTION 3. Section 36.004(b-1), Health and Safety Code, is
5959 amended to read as follows:
6060 (b-1) The rules must allow an individual who attends a
6161 public or private school to be screened:
6262 (1) using photoscreening to detect vision disorders;
6363 [and]
6464 (2) using an electronic eye chart as a substitute for a
6565 printed eye chart to assess visual acuity; and
6666 (3) using visual screening techniques to detect depth
6767 perception issues and color blindness.
6868 SECTION 4. Section 36.006, Health and Safety Code, is
6969 amended by adding Subsections (a-1) and (a-2) to read as follows:
7070 (a-1) The form prescribed by the department under
7171 Subsection (a) must include:
7272 (1) separate spaces for the student's first and last
7373 name;
7474 (2) a space for the preschool's or school's name;
7575 (3) a space for the student's grade level; and
7676 (4) information for a student's parents regarding
7777 available resources for low-cost vision care.
7878 (a-2) The department shall biennially update the form
7979 information required under Subsection (a-1)(4).
8080 SECTION 5. (a) As soon as practicable after the effective
8181 date of this Act, the commissioner of education shall adopt rules
8282 necessary to implement Sections 38.035 and 48.1035, Education Code,
8383 as added by this Act.
8484 (b) The executive commissioner of the Health and Human
8585 Services Commission shall, as soon as practicable after the
8686 effective date of this Act, adopt rules necessary to implement the
8787 changes in law made by this Act to Chapter 36, Health and Safety
8888 Code.
8989 SECTION 6. This Act takes effect September 1, 2025.
