| 9 | 9 | | relating to the designation of spaceports as critical |
|---|
| 10 | 10 | | infrastructure facilities for purposes of criminal and civil |
|---|
| 11 | 11 | | liability. |

| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Section 424.001, Government Code, is amended to |
|---|
| 14 | 14 | | read as follows: |
|---|
| 15 | 15 | | Sec. 424.001. DEFINITION. In this chapter, "critical |
|---|
| 16 | 16 | | infrastructure facility" has the meaning assigned by Section |
|---|
| 17 | 17 | | 423.0045(a)(1-a) and also includes: |
|---|
| 18 | 18 | | (1) any pipeline transporting oil or gas or the |
|---|
| 19 | 19 | | products or constituents of oil or gas; |
|---|
| 20 | 20 | | (2) a public or private airport depicted in any |
|---|
| 21 | 21 | | current aeronautical chart published by the Federal Aviation |
|---|
| 22 | 22 | | Administration; |
|---|
| 23 | 23 | | (3) a military installation owned or operated by or |
|---|
| 24 | 24 | | for the federal government, this state, or another governmental |
|---|
| 25 | 25 | | entity; [and] |
|---|
| 26 | 26 | | (4) any property or facility that is: |
|---|
| 27 | 27 | | (A) used for the launch, landing, or recovery of |
|---|
| 28 | 28 | | spacecraft, as defined by Section 507.001, Local Government Code; |
|---|
| 29 | 29 | | and |
|---|
| 30 | 30 | | (B) licensed by the Federal Aviation |
|---|
| 31 | 31 | | Administration or operated by a spaceport development corporation |
|---|
| 32 | 32 | | under Chapter 507, Local Government Code; and |
|---|
| 33 | 33 | | (5) a property, facility, or pipeline described by |
|---|
| 34 | 34 | | this section that is under construction and all equipment and |
|---|
| 35 | 35 | | appurtenances used during that construction. |
|---|
| 36 | 36 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 37 | 37 | | to an offense committed on or after the effective date of this Act. |
|---|
| 38 | 38 | | An offense committed before the effective date of this Act is |
|---|
| 39 | 39 | | governed by the law in effect on the date the offense was committed, |
|---|
| 40 | 40 | | and the former law is continued in effect for that purpose. For |
|---|
| 41 | 41 | | purposes of this section, an offense was committed before the |
|---|
| 42 | 42 | | effective date of this Act if any element of the offense was |
|---|
| 43 | 43 | | committed before that date. |
|---|
| 44 | 44 | | SECTION 3. The change in law made by this Act applies only |
|---|
| 45 | 45 | | to a cause of action that accrues on or after the effective date of |
|---|
| 46 | 46 | | this Act. A cause of action that accrues before the effective date |
|---|
| 47 | 47 | | of this Act is governed by the law in effect on the date the cause of |
|---|
| 48 | 48 | | action accrued, and the former law is continued in effect for that |
|---|
| 49 | 49 | | purpose. |
|---|
| 50 | 50 | | SECTION 4. This Act takes effect September 1, 2025. |
