11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Subchapter A, Chapter 38, Education Code, is | |
13 | 13 | amended by adding Section 38.046 to read as follows: | |
14 | 14 | Sec. 38.046. REPORTING OF CONTROLLED SUBSTANCE OVERDOSES. | |
15 | 15 | (a) In this section, "overdose" has the meaning assigned by Section | |
16 | 16 | 161.045, Health and Safety Code. | |
17 | 17 | (b) Each school district campus shall report each overdose | |
18 | 18 | that occurs at the campus as soon as practicable after the overdose | |
19 | 19 | occurs to: | |
20 | 20 | (1) the school district; and | |
21 | 21 | (2) the executive commissioner of the Health and Human | |
22 | 22 | Services Commission. | |
23 | 23 | (c) The commissioner and the executive commissioner of the | |
24 | 24 | Health and Human Services Commission jointly shall adopt rules as | |
25 | 25 | necessary to implement this section in a manner that complies with | |
26 | 26 | federal law regarding confidentiality of student medical or | |
27 | 27 | educational information, including the Health Insurance | |
28 | 28 | Portability and Accountability Act of 1996 (42 U.S.C. Section 1320d | |
29 | 29 | et seq.) and the Family Educational Rights and Privacy Act of 1974 | |
30 | 30 | (20 U.S.C. Section 1232g), and any state law relating to the privacy | |
31 | 31 | of student information. | |
32 | 32 | SECTION 2. This Act takes effect September 1, 2025. |
