77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the reporting of a controlled substance overdose
1010 occurring on the campus of a public school.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter A, Chapter 38, Education Code, is
1313 amended by adding Section 38.046 to read as follows:
1414 Sec. 38.046. REPORTING OF CONTROLLED SUBSTANCE OVERDOSES.
1515 (a) In this section, "overdose" has the meaning assigned by Section
1616 161.045, Health and Safety Code.
1717 (b) Each school district campus shall report each overdose
1818 that occurs at the campus as soon as practicable after the overdose
1919 occurs to:
2020 (1) the school district; and
2121 (2) the executive commissioner of the Health and Human
2222 Services Commission.
2323 (c) The commissioner and the executive commissioner of the
2424 Health and Human Services Commission jointly shall adopt rules as
2525 necessary to implement this section in a manner that complies with
2626 federal law regarding confidentiality of student medical or
2727 educational information, including the Health Insurance
2828 Portability and Accountability Act of 1996 (42 U.S.C. Section 1320d
2929 et seq.) and the Family Educational Rights and Privacy Act of 1974
3030 (20 U.S.C. Section 1232g), and any state law relating to the privacy
3131 of student information.
3232 SECTION 2. This Act takes effect September 1, 2025.
