77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to law enforcement policies prohibiting a peace officer
1010 from using less lethal projectiles for the purpose of controlling
1111 the activity or movement of a gathering of people.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter F, Chapter 2B, Code of Criminal
1414 Procedure, is amended by adding Article 2B.0254 to read as follows:
1515 Art. 2B.0254. LAW ENFORCEMENT POLICY PROHIBITING USE OF
1616 CERTAIN AMMUNITION FOR CROWD CONTROL. (a) In this article:
1717 (1) "Law enforcement agency" means an agency of the
1818 state or an agency of a political subdivision of the state
1919 authorized by law to appoint or employ peace officers.
2020 (2) "Less lethal projectile" means ammunition that is
2121 discharged from a firearm or other device for the purpose of
2222 incapacitating or substantially diminishing the capacity of the
2323 target by inflicting blunt trauma and that is designed to reduce the
2424 risk of serious bodily injury or death compared to more commonly
2525 used ammunition such as bullets or other projectiles composed
2626 primarily or entirely of metal. The term includes ammunition
2727 commonly known as "rubber bullets," "wooden bullets," "sponge
2828 rounds," and "bean bag rounds."
2929 (b) Each law enforcement agency in this state shall adopt a
3030 policy on crowd control that prohibits a peace officer appointed or
3131 employed by the agency from using less lethal projectiles as a means
3232 to control the activity or movement of a gathering of people.
3333 SECTION 2. Not later than January 1, 2026, each law
3434 enforcement agency in this state shall adopt the policy required by
3535 Article 2B.0254, Code of Criminal Procedure, as added by this Act.
3636 SECTION 3. This Act takes effect September 1, 2025.
