119 relating to the name, rights, powers, and privileges of the Cedar

1311 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1412 SECTION 1. The heading to Chapter 3854, Special District
1513 Local Laws Code, is amended to read as follows:
1614 CHAPTER 3854. CEDAR PORT NAVIGATION AND IMPROVEMENT DISTRICT
1715 [CHAMBERS COUNTY IMPROVEMENT DISTRICT NO. 1]
1816 SECTION 2. Section 3854.001(3), Special District Local Laws
1917 Code, is amended to read as follows:
2018 (3) "District" means the Cedar Port Navigation and
2119 Improvement District [Chambers County Improvement District No. 1].
2220 SECTION 3. Section 3854.002, Special District Local Laws
2321 Code, is amended to read as follows:
2422 Sec. 3854.002. NATURE OF DISTRICT. A special district
2523 known as the "Cedar Port Navigation and Improvement District"
2624 ["Chambers County Improvement District No. 1"] is a political
2725 subdivision of this state.
2826 SECTION 4. Section 3854.151, Special District Local Laws
2927 Code, is amended to read as follows:

4644 (3) all the powers granted to municipal management
4745 districts under Sections 375.092 and 375.111, Local Government
4846 Code, to provide any services or for any project the district is
4947 authorized to acquire, construct, or improve under this chapter.
50- SECTION 5. Subchapter D, Chapter 3854, Special District
51- Local Laws Code, is amended by adding Section 3854.1515 to read as
52- follows:
53- Sec. 3854.1515. ACTING AS NONFEDERAL SPONSOR. If authorized
54- by the United States, notwithstanding Section 60.033, Water Code,
55- or any other state law, the district may exercise all rights,
56- powers, and privileges necessary to allow the district to act as a
57- nonfederal sponsor under a federal project partnership agreement,
58- including by operating barges, engaging in dredging, and engaging
59- in related maritime operations on water that is not in the territory
60- of the district.
61- SECTION 6. Section 3854.153, Special District Local Laws
48+ (b) Section 60.033, Water Code, does not apply to the
49+ district.

8271 to the notice, introduction, and passage of this Act are fulfilled
8372 and accomplished.
84- SECTION 8. This Act takes effect immediately if it receives
