10	8		AN ACT
11	9		relating to the name, rights, powers, and privileges of the Cedar
12	10		Port Navigation and Improvement District.
13	11		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
14	12		SECTION 1. The heading to Chapter 3854, Special District
15	13		Local Laws Code, is amended to read as follows:
16	14		CHAPTER 3854. CEDAR PORT NAVIGATION AND IMPROVEMENT DISTRICT
17	15		[CHAMBERS COUNTY IMPROVEMENT DISTRICT NO. 1]
18	16		SECTION 2. Section 3854.001(3), Special District Local Laws
19	17		Code, is amended to read as follows:
20	18		(3) "District" means the Cedar Port Navigation and
21	19		Improvement District [Chambers County Improvement District No. 1].
22	20		SECTION 3. Section 3854.002, Special District Local Laws
23	21		Code, is amended to read as follows:
24	22		Sec. 3854.002. NATURE OF DISTRICT. A special district
25	23		known as the "Cedar Port Navigation and Improvement District"
26	24		["Chambers County Improvement District No. 1"] is a political
27	25		subdivision of this state.
28	26		SECTION 4. Section 3854.151, Special District Local Laws
29	27		Code, is amended to read as follows:
30		-	Sec. 3854.151. GENERAL POWERS. The district has:

31	29		(1) all the rights, powers, and privileges conferred
32	30		by the general law of this state applicable to districts created

36	34		623, Acts of the 67th Legislature, Regular Session, 1981 (former
37	35		Article 6550c, Vernon's Texas Civil Statutes);

39	37		(D) Chapters 49 and [Chapter] 54, Water Code;
40	38		(2) the rights, powers, and privileges granted to
41	39		districts by:
42	40		(A) [Subchapters E and M,] Chapter 60, Water
43	41		Code; and
44	42		(B) Sections [Section] 61.116 and 62.118, Water
45	43		Code; and
46	44		(3) all the powers granted to municipal management
47	45		districts under Sections 375.092 and 375.111, Local Government
48	46		Code, to provide any services or for any project the district is
49	47		authorized to acquire, construct, or improve under this chapter.
50		-	SECTION 5. Subchapter D, Chapter 3854, Special District
51		-	Local Laws Code, is amended by adding Section 3854.1515 to read as
52		-	follows:
53		-	Sec. 3854.1515. ACTING AS NONFEDERAL SPONSOR. If authorized
54		-	by the United States, notwithstanding Section 60.033, Water Code,
55		-	or any other state law, the district may exercise all rights,
56		-	powers, and privileges necessary to allow the district to act as a
57		-	nonfederal sponsor under a federal project partnership agreement,
58		-	including by operating barges, engaging in dredging, and engaging
59		-	in related maritime operations on water that is not in the territory
60		-	of the district.
61		-	SECTION 6. Section 3854.153, Special District Local Laws

62	51		Code, is amended to read as follows:
63	52		Sec. 3854.153. AUTHORITY TO ACQUIRE INTEREST IN LAND. The
64	53		district may acquire any interest in land in accordance with
65	54		Chapter 49, [Chapter] 54, or 60, Water Code.
66		-	SECTION 7. (a) The legal notice of the intention to

73	62		(b) The governor, one of the required recipients, has
74	63		submitted the notice and Act to the Texas Commission on
75	64		Environmental Quality.
76	65		(c) The Texas Commission on Environmental Quality has filed
77	66		its recommendations relating to this Act with the governor, the
78	67		lieutenant governor, and the speaker of the house of
79	68		representatives within the required time.
80	69		(d) All requirements of the constitution and laws of this
81	70		state and the rules and procedures of the legislature with respect
82	71		to the notice, introduction, and passage of this Act are fulfilled
83	72		and accomplished.
84		-	SECTION 8. This Act takes effect immediately if it receives
