77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the provision of medication for respiratory distress in
1010 public and private schools.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 38.211, Education Code, is amended by
1313 adding Subsection (b-1) and amending Subsection (c) to read as
1414 follows:
1515 (b-1) The commissioner of state health services or, if the
1616 commissioner is not a physician, the chief medical executive of the
1717 Department of State Health Services may issue a statewide standing
1818 order prescribing medication for respiratory distress to a school
1919 district, open-enrollment charter school, or private school.
2020 (c) The standing order under Subsection (b) or (b-1) is not
2121 required to be patient-specific, and the epinephrine auto-injector
2222 or medication for respiratory distress may be administered to a
2323 person without a previously established physician-patient
2424 relationship.
2525 SECTION 2. Subchapter E, Chapter 38, Education Code, is
2626 amended by adding Section 38.2115 to read as follows:
2727 Sec. 38.2115. CONTRACTING FOR MEDICATION FOR RESPIRATORY
2828 DISTRESS AND TRAINING. The board of trustees of a school district
2929 or governing body of an open-enrollment charter school or private
3030 school may contract with a vendor to provide:
3131 (1) medication for respiratory distress and related
3232 equipment to the district or school; and
3333 (2) training to school personnel and school volunteers
3434 authorized to administer medication for respiratory distress under
3535 this subchapter.
3636 SECTION 3. This Act takes effect immediately if it receives
3737 a vote of two-thirds of all the members elected to each house, as
3838 provided by Section 39, Article III, Texas Constitution. If this
3939 Act does not receive the vote necessary for immediate effect, this
4040 Act takes effect September 1, 2025.
