| 11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 12 | 12 | SECTION 1. Section 2251.002, Government Code, is amended by | |
| 13 | 13 | adding Subsection (c) to read as follows: | |
| 14 | 14 | (c) For purposes of this chapter, a bona fide dispute with | |
| 15 | 15 | respect to a contract for the construction of a public work does not | |
| 16 | 16 | include an audit of the public work project that continues for more | |
| 17 | 17 | than 60 days after the date of the substantial completion of the | |
| 18 | 18 | project. | |
| 19 | 19 | SECTION 2. Section 28.003, Property Code, is amended by | |
| 20 | 20 | adding Subsection (c) to read as follows: | |
| 21 | 21 | (c) For purposes of Subsection (a) or (b), a good faith | |
| 22 | 22 | dispute does not include an audit of the construction or | |
| 23 | 23 | improvement project under contract that continues for more than 60 | |
| 24 | 24 | days after the date of the substantial completion of the project. | |
| 25 | 25 | SECTION 3. The changes in law made by this Act apply only to | |
| 26 | 26 | a contract that is entered into on or after the effective date of | |
| 27 | 27 | this Act. | |
| 28 | 28 | SECTION 4. This Act takes effect September 1, 2025. |
