77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the purchase and installation of climate control
1010 systems at facilities operated by the Texas Department of Criminal
1111 Justice.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. (a) In this section:
1414 (1) "Department" means the Texas Department of
1515 Criminal Justice.
1616 (2) "Required temperature-controlled area" means the
1717 following areas of a facility operated by the department:
1818 (A) hospitals;
1919 (B) visiting areas;
2020 (C) housing or dormitory areas;
2121 (D) trustee areas;
2222 (E) areas used for medical treatment or care,
2323 including areas used for dispensing medication to inmates;
2424 (F) kitchens or dining areas;
2525 (G) food preparation areas;
2626 (H) community areas, including dayrooms;
2727 (I) laundry areas;
2828 (J) areas used for work stations;
2929 (K) indoor recreational areas, including
3030 gymnasiums;
3131 (L) restroom and shower areas and other areas
3232 related to inmate hygiene;
3333 (M) administrative areas;
3434 (N) correctional officer stations, including
3535 guard post areas;
3636 (O) commissary areas;
3737 (P) areas used for programmatic, educational, or
3838 vocational purposes;
3939 (Q) chapels or churches;
4040 (R) libraries; and
4141 (S) maintenance areas.
4242 (b) The department shall:
4343 (1) contract with a private entity through a
4444 competitive bidding process to purchase and install climate control
4545 systems at each facility operated by the department that is not
4646 currently equipped with a climate control system capable of
4747 maintaining the temperature in the required temperature-controlled
4848 areas of the facility at not less than 65 degrees Fahrenheit or more
4949 than 85 degrees Fahrenheit; and
5050 (2) install the climate control systems in the
5151 following phases, with each phase consisting of the installation of
5252 climate control systems at approximately one-third of the
5353 department's facilities at a cost not to exceed $100 million per
5454 phase:
5555 (A) phase one to be completed not later than
5656 December 31, 2028;
5757 (B) phase two to be completed not later than
5858 December 31, 2030; and
5959 (C) phase three to be completed not later than
6060 December 31, 2032.
6161 (c) In conducting the competitive bidding process, the
6262 department shall solicit bids for the entire scope of the project,
6363 provided that the department may solicit bids for each phase of the
6464 project if necessary or beneficial.
6565 (d) In soliciting bids and determining the requirements for
6666 the phased implementation of the project, the department shall:
6767 (1) prioritize the efficient use of state resources;
6868 and
6969 (2) consider factors such as:
7070 (A) the type of climate control systems needed
7171 for each facility, including the architectural design of each
7272 facility;
7373 (B) the ability of any existing climate control
7474 systems in each facility to maintain the air temperature in the
7575 required temperature-controlled areas of the facility at not less
7676 than 65 degrees Fahrenheit or more than 85 degrees Fahrenheit;
7777 (C) the comparable abilities of different
7878 climate control systems to maintain the temperature described by
7979 Paragraph (B) of this subdivision, including the total cellblock or
8080 dormitory square footage each system is capable of maintaining at
8181 that temperature; and
8282 (D) the use of inmate labor to decrease costs.
8383 SECTION 2. This Act expires January 1, 2035.
8484 SECTION 3. (a) The Texas Department of Criminal Justice is
8585 required to implement a provision of this Act only if:
8686 (1) the legislature allocates available federal funds
8787 specifically for that purpose; or
8888 (2) the legislature specifically appropriates state
8989 funds to the department for the purpose of implementing a provision
9090 of this Act.
9191 (b) Except as provided by Subsection (a)(2) of this section,
9292 the Texas Department of Criminal Justice may not implement a
9393 provision of this Act using state funds.
9494 SECTION 4. This Act takes effect immediately if it receives
9595 a vote of two-thirds of all the members elected to each house, as
9696 provided by Section 39, Article III, Texas Constitution. If this
9797 Act does not receive the vote necessary for immediate effect, this
9898 Act takes effect September 1, 2025.
