119 relating to the establishment of the Rural Infrastructure Disaster
1210 Recovery Program.
1311 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1412 SECTION 1. Chapter 418, Government Code, is amended by
1513 adding Subchapter D-1 to read as follows:
1614 SUBCHAPTER D-1. RURAL INFRASTRUCTURE DISASTER RECOVERY PROGRAM
1715 Sec. 418.081. DEFINITIONS. In this subchapter:
1816 (1) "Account" means the rural infrastructure disaster
1917 recovery account created under Section 418.086.
2018 (2) "Critical infrastructure" includes:
2119 (A) a road;
2220 (B) a public school;
2321 (C) a hospital or other health care facility;
2422 (D) a water intake structure, water treatment
2523 facility, wastewater treatment plant, or pump station;
2624 (E) utility-scale water or wastewater storage,
2725 treatment, or transmission facilities; and
2826 (F) airport facilities used for the landing,
2927 parking, refueling, shelter, or takeoff of aircraft, maintenance or
3028 servicing of aircraft, aircraft equipment storage, or navigation of
3129 aircraft.
3230 (3) "Disaster area" means an area in this state
3331 declared to be a disaster area by the governor.
3432 (4) "Eligible political subdivision" means a
3533 political subdivision that meets the qualifications prescribed by
3634 Section 418.083.
3735 (5) "Political subdivision," notwithstanding Section
3836 418.004, means a county, municipality, special district, school
3937 district, junior college district, or other political subdivision
4038 of this state.
4139 Sec. 418.082. RURAL INFRASTRUCTURE DISASTER RECOVERY
4240 PROGRAM. (a) The division shall establish and administer a rural
4341 infrastructure disaster recovery program in accordance with this
4442 subchapter to benefit eligible political subdivisions. The program
4543 must be designed to provide financial assistance in the form of
4644 grants to rural communities located in a disaster area for the
4745 purpose of rebuilding and repairing critical infrastructure
4846 damaged by a disaster.
4947 (b) The division may make grants in accordance with this
5048 subchapter using money appropriated to the division for the
5149 purposes of this subchapter.
5250 Sec. 418.083. ELIGIBILITY FOR GRANT. A political
5351 subdivision is eligible to apply to the division for a grant under
5452 this subchapter if the political subdivision is:
5553 (1) a county:
5654 (A) that:
5755 (i) has a population of less than 100,000;
5856 (ii) has a gross domestic product of less
5957 than $2 billion;
6058 (iii) has a poverty rate greater than 15
6159 percent; and
6260 (iv) is located wholly or partly in a
6361 disaster area; and
6462 (B) for which the total dollar amount of damages
6563 resulting from the disaster, as shown in an assessment of damages
6664 prepared after the disaster, exceeds the amount equal to 10 percent
6765 of the state and local sales and use taxes collected in the county
6866 during the state fiscal year preceding the year in which the
6967 disaster occurs; or
7068 (2) a political subdivision other than a county that
7169 is wholly or partly located in a county described by Subdivision
7270 (1).
7371 Sec. 418.084. GRANT PROGRAM. (a) The division may make a
7472 grant to an eligible political subdivision using money in the
7573 account to assist in the rebuilding or repair of critical
7674 infrastructure located in the eligible political subdivision that
7775 is damaged by a disaster that may reasonably be considered a public
7876 calamity.
7977 (b) The proceeds of a grant made by the division using money
8078 in the account may not be used by the eligible political subdivision
8179 receiving the grant for any purpose other than the purpose
8280 described by Subsection (a).
8381 Sec. 418.085. APPLICATION FOR GRANT. (a) The division
8482 shall establish an application process for a grant under this
8583 subchapter.
8684 (b) At a minimum, an application must include:
8785 (1) a description of the infrastructure repair or
8886 rebuild project for which the applicant is requesting the grant;
89- (2) an estimate of the total cost of the project;
90- (3) documentation that the project does not qualify
91- for federal funding through the Federal Emergency Management
92- Agency; and
93- (4) any other information the division requests to

88+ (3) any other information the division requests to
9489 determine whether the applicant is an eligible political
9590 subdivision.
9691 Sec. 418.086. RURAL INFRASTRUCTURE DISASTER RECOVERY
9792 ACCOUNT. (a) The rural infrastructure disaster recovery account
9893 is established as an account in the general revenue fund with the
9994 comptroller, to be administered by the division.
100- (b) The division may use the rural infrastructure disaster
101- recovery account only for:
102- (1) making a grant to an eligible political
103- subdivision; and
104- (2) paying the necessary and reasonable expenses of
105- administering the grant.
95+ (b) Money in the account may be used only to provide a grant
96+ in the manner provided by this subchapter.
10697 (c) The account consists of:
10798 (1) money appropriated, credited, or transferred to
10899 the account by the legislature;
109100 (2) gifts or grants contributed to the account; and
110101 (3) interest earned on deposits and investments of the
111102 account.
112- Sec. 418.087. RULES. The division shall adopt rules
113- necessary to administer this subchapter, including rules
114- establishing procedures for the application for and award of
115- grants, distribution of grants, and administration of grants and
116- the grant program established under this subchapter.
117103 SECTION 2. This Act takes effect September 1, 2025.
