| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Section 38.211, Education Code, is amended by |
|---|
| 14 | 14 | | adding Subsection (b-1) and amending Subsection (c) to read as |
|---|
| 15 | 15 | | follows: |
|---|
| 16 | 16 | | (b-1) The commissioner of state health services or, if the |
|---|
| 17 | 17 | | commissioner is not a physician, the chief medical executive of the |
|---|
| 18 | 18 | | Department of State Health Services shall issue statewide standing |
|---|
| 19 | 19 | | orders prescribing epinephrine auto-injectors and medication for |
|---|
| 20 | 20 | | respiratory distress to a school district, open-enrollment charter |
|---|
| 21 | 21 | | school, or private school. |
|---|
| 22 | 22 | | (c) The standing order under Subsection (b) or (b-1) is not |
|---|
| 23 | 23 | | required to be patient-specific, and the epinephrine auto-injector |
|---|
| 24 | 24 | | or medication for respiratory distress may be administered to a |
|---|
| 25 | 25 | | person without a previously established physician-patient |
|---|
| 26 | 26 | | relationship. |

| 27 | 27 | | SECTION 2. Section 38.225, Education Code, is amended by |
|---|
| 28 | 28 | | adding Subsection (b-1) and amending Subsection (c) to read as |
|---|
| 29 | 29 | | follows: |
|---|
| 30 | 30 | | (b-1) The commissioner of state health services or, if the |
|---|
| 31 | 31 | | commissioner is not a physician, the chief medical executive of the |
|---|
| 32 | 32 | | Department of State Health Services shall issue a statewide |
|---|
| 33 | 33 | | standing order prescribing opioid antagonists to a school district, |
|---|
| 34 | 34 | | open-enrollment charter school, or private school. |
|---|
| 35 | 35 | | (c) The standing order under Subsection (b) or (b-1) is not |
|---|
| 36 | 36 | | required to be patient-specific, and the opioid antagonist may be |
|---|
| 37 | 37 | | administered to a person without a previously established |
|---|
| 38 | 38 | | physician-patient relationship. |
|---|
| 39 | 39 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 40 | 40 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 41 | 41 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 42 | 42 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 43 | 43 | | Act takes effect September 1, 2025. |
|---|
