77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to statewide standing orders prescribing epinephrine
1010 auto-injectors, medication for respiratory distress, and opioid
1111 antagonists to public and private schools.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 38.211, Education Code, is amended by
1414 adding Subsection (b-1) and amending Subsection (c) to read as
1515 follows:
1616 (b-1) The commissioner of state health services or, if the
1717 commissioner is not a physician, the chief medical executive of the
1818 Department of State Health Services shall issue statewide standing
1919 orders prescribing epinephrine auto-injectors and medication for
2020 respiratory distress to a school district, open-enrollment charter
2121 school, or private school.
2222 (c) The standing order under Subsection (b) or (b-1) is not
2323 required to be patient-specific, and the epinephrine auto-injector
2424 or medication for respiratory distress may be administered to a
2525 person without a previously established physician-patient
2626 relationship.
2727 SECTION 2. Section 38.225, Education Code, is amended by
2828 adding Subsection (b-1) and amending Subsection (c) to read as
2929 follows:
3030 (b-1) The commissioner of state health services or, if the
3131 commissioner is not a physician, the chief medical executive of the
3232 Department of State Health Services shall issue a statewide
3333 standing order prescribing opioid antagonists to a school district,
3434 open-enrollment charter school, or private school.
3535 (c) The standing order under Subsection (b) or (b-1) is not
3636 required to be patient-specific, and the opioid antagonist may be
3737 administered to a person without a previously established
3838 physician-patient relationship.
3939 SECTION 3. This Act takes effect immediately if it receives
4040 a vote of two-thirds of all the members elected to each house, as
4141 provided by Section 39, Article III, Texas Constitution. If this
4242 Act does not receive the vote necessary for immediate effect, this
4343 Act takes effect September 1, 2025.
