| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 39.306, Education Code, is amended by |
|---|
| 13 | 13 | | amending Subsection (d-1) and adding Subsection (d-2) to read as |
|---|
| 14 | 14 | | follows: |
|---|
| 15 | 15 | | (d-1) The report must also include, based on the information |
|---|
| 16 | 16 | | included in the report under Subsection (d-2), an evaluation of a |
|---|
| 17 | 17 | | school district's school counseling program. |
|---|
| 18 | 18 | | (d-2) The report must also include: |
|---|
| 19 | 19 | | (1) the number of school counselors providing |
|---|
| 20 | 20 | | counseling services at each campus; |
|---|
| 21 | 21 | | (2) the average number of hours a school counselor |
|---|
| 22 | 22 | | spent on: |
|---|
| 23 | 23 | | (A) duties that are components of a counseling |
|---|
| 24 | 24 | | program developed under Section 33.005; and |
|---|
| 25 | 25 | | (B) duties that are not components of a |
|---|
| 26 | 26 | | counseling program described by Paragraph (A), including the |
|---|
| 27 | 27 | | average number of hours spent administering or providing assistance |
|---|
| 28 | 28 | | in connection with assessment instruments, except for time spent |
|---|
| 29 | 29 | | interpreting data from assessment instruments; and |
|---|
| 30 | 30 | | (3) the findings, conclusions, and other relevant |
|---|
| 31 | 31 | | information from the district's assessment of the district's |
|---|
| 32 | 32 | | compliance with the policy adopted under Section 33.006(d) required |
|---|
| 33 | 33 | | under Subsection (h) of that section. |
|---|
| 34 | 34 | | SECTION 2. This Act applies beginning with the 2025-2026 |
|---|
| 35 | 35 | | school year. |
|---|
| 36 | 36 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 37 | 37 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 38 | 38 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 39 | 39 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 40 | 40 | | Act takes effect September 1, 2025. |
