77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to requiring parental consent for the use of corporal
1010 punishment in public schools.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 37.0011, Education Code, is amended by
1313 amending Subsections (b), (c), and (d) and adding Subsection (e) to
1414 read as follows:
1515 (b) If the board of trustees of an independent school
1616 district adopts a policy under Section 37.001(a)(8) under which
1717 corporal punishment is permitted as a method of student discipline,
1818 a district educator may use corporal punishment to discipline a
1919 student only if [unless] the student's parent or guardian or other
2020 person having lawful control over the student has previously
2121 provided [a] written, signed consent to [statement prohibiting] the
2222 use of corporal punishment as a method of student discipline.
2323 (c) To provide consent for [prohibit] the use of corporal
2424 punishment as a method of student discipline, [each school year] a
2525 student's parent or guardian or other person having lawful control
2626 over the student must provide [a] separate written, signed consent
2727 [statement] to the board of trustees of the school district in the
2828 manner established by the board. Subject to Subsection (e),
2929 consent under this subsection is effective until:
3030 (1) consent is revoked under Subsection (d); or
3131 (2) the student is no longer enrolled in the district.
3232 (d) The student's parent or guardian or other person having
3333 lawful control over the student may revoke the consent [statement]
3434 provided to the board of trustees under Subsection (c) at any time
3535 during the school year by submitting a written, signed revocation
3636 to the board in the manner established by the board.
3737 (e) The board of trustees of a school district may adopt
3838 rules requiring a student's parent or guardian or other person
3939 having lawful control over the student to renew the consent under
4040 Subsection (c) each school year.
4141 SECTION 2. This Act applies beginning with the 2025-2026
4242 school year.
4343 SECTION 3. This Act takes effect immediately if it receives
4444 a vote of two-thirds of all the members elected to each house, as
4545 provided by Section 39, Article III, Texas Constitution. If this
4646 Act does not receive the vote necessary for immediate effect, this
4747 Act takes effect September 1, 2025.
