9 | 9 | | relating to requiring parental consent for the use of corporal |

10 | 10 | | punishment in public schools. |

11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Section 37.0011, Education Code, is amended by |
---|
13 | 13 | | amending Subsections (b), (c), and (d) and adding Subsection (e) to |
---|
14 | 14 | | read as follows: |
---|
15 | 15 | | (b) If the board of trustees of an independent school |
---|
16 | 16 | | district adopts a policy under Section 37.001(a)(8) under which |
---|
17 | 17 | | corporal punishment is permitted as a method of student discipline, |
---|
18 | 18 | | a district educator may use corporal punishment to discipline a |
---|
19 | 19 | | student only if [unless] the student's parent or guardian or other |
---|
20 | 20 | | person having lawful control over the student has previously |
---|
21 | 21 | | provided [a] written, signed consent to [statement prohibiting] the |
---|
22 | 22 | | use of corporal punishment as a method of student discipline. |
---|
23 | 23 | | (c) To provide consent for [prohibit] the use of corporal |
---|
24 | 24 | | punishment as a method of student discipline, [each school year] a |
---|
25 | 25 | | student's parent or guardian or other person having lawful control |
---|
26 | 26 | | over the student must provide [a] separate written, signed consent |
---|
27 | 27 | | [statement] to the board of trustees of the school district in the |
---|
28 | 28 | | manner established by the board. Subject to Subsection (e), |
---|
29 | 29 | | consent under this subsection is effective until: |
---|
30 | 30 | | (1) consent is revoked under Subsection (d); or |
---|
31 | 31 | | (2) the student is no longer enrolled in the district. |
---|
32 | 32 | | (d) The student's parent or guardian or other person having |
---|
33 | 33 | | lawful control over the student may revoke the consent [statement] |
---|
34 | 34 | | provided to the board of trustees under Subsection (c) at any time |
---|
35 | 35 | | during the school year by submitting a written, signed revocation |
---|
36 | 36 | | to the board in the manner established by the board. |
---|
37 | 37 | | (e) The board of trustees of a school district may adopt |
---|
38 | 38 | | rules requiring a student's parent or guardian or other person |
---|
39 | 39 | | having lawful control over the student to renew the consent under |
---|
40 | 40 | | Subsection (c) each school year. |
---|
41 | 41 | | SECTION 2. This Act applies beginning with the 2025-2026 |
---|
42 | 42 | | school year. |
---|
43 | 43 | | SECTION 3. This Act takes effect immediately if it receives |
---|
44 | 44 | | a vote of two-thirds of all the members elected to each house, as |
---|
45 | 45 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
46 | 46 | | Act does not receive the vote necessary for immediate effect, this |
---|
47 | 47 | | Act takes effect September 1, 2025. |
