| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Section 707.001, Transportation Code, is amended |
|---|
| 14 | 14 | | by adding Subdivision (4-a) to read as follows: |
|---|
| 15 | 15 | | (4-a) "School bus infraction detection system" means a |
|---|
| 16 | 16 | | camera system affixed to a school bus with two or more camera |
|---|
| 17 | 17 | | sensors or computers that produce a recorded video and two or more |
|---|
| 18 | 18 | | film or digital photographic still images for the purpose of |
|---|
| 19 | 19 | | detecting violations described by Section 545.066. |
|---|
| 20 | 20 | | SECTION 2. Section 707.020, Transportation Code, is amended |
|---|
| 21 | 21 | | by amending Subsection (a) and adding Subsection (a-1) to read as |
|---|
| 22 | 22 | | follows: |
|---|
| 23 | 23 | | (a) Notwithstanding any other law and except as provided by |
|---|
| 24 | 24 | | Subsection (a-1), a local authority may not implement or operate a |
|---|
| 25 | 25 | | photographic traffic signal enforcement system with respect to a |
|---|
| 26 | 26 | | highway or street under the jurisdiction of the authority. |
|---|
| 27 | 27 | | (a-1) This section does not apply to a school bus infraction |
|---|
| 28 | 28 | | detection system installed and operated by a school district or |
|---|
| 29 | 29 | | open-enrollment charter school in this state. |
|---|
| 30 | 30 | | SECTION 3. Section 707.021, Transportation Code, is amended |
|---|
| 31 | 31 | | to read as follows: |
|---|
| 32 | 32 | | Sec. 707.021. USE OF EVIDENCE FROM PHOTOGRAPHIC TRAFFIC |
|---|
| 33 | 33 | | SIGNAL ENFORCEMENT SYSTEM PROHIBITED. (a) Notwithstanding any |
|---|
| 34 | 34 | | other law and except as provided by Subsection (b), a local |
|---|
| 35 | 35 | | authority may not issue a civil or criminal charge or citation for |
|---|
| 36 | 36 | | an offense or violation based on a recorded image produced by a |
|---|
| 37 | 37 | | photographic traffic signal enforcement system. |
|---|
| 38 | 38 | | (b) This section does not apply to the issuance by a |
|---|
| 39 | 39 | | municipality, county, school district, or open-enrollment charter |
|---|
| 40 | 40 | | school of a civil or criminal charge or citation, as applicable, for |
|---|
| 41 | 41 | | a violation described by Section 545.066 based on the use of |
|---|
| 42 | 42 | | recorded image-based evidence collected from a school bus |
|---|
| 43 | 43 | | infraction detection system installed and operated by a school |
|---|
| 44 | 44 | | district or open-enrollment charter school in this state. |
|---|
| 45 | 45 | | SECTION 4. This Act takes effect September 1, 2025. |
