77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the enforcement of the prohibition on passing a school
1010 bus using images and video from a school bus infraction detection
1111 system.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 707.001, Transportation Code, is amended
1414 by adding Subdivision (4-a) to read as follows:
1515 (4-a) "School bus infraction detection system" means a
1616 camera system affixed to a school bus with two or more camera
1717 sensors or computers that produce a recorded video and two or more
1818 film or digital photographic still images for the purpose of
1919 detecting violations described by Section 545.066.
2020 SECTION 2. Section 707.020, Transportation Code, is amended
2121 by amending Subsection (a) and adding Subsection (a-1) to read as
2222 follows:
2323 (a) Notwithstanding any other law and except as provided by
2424 Subsection (a-1), a local authority may not implement or operate a
2525 photographic traffic signal enforcement system with respect to a
2626 highway or street under the jurisdiction of the authority.
2727 (a-1) This section does not apply to a school bus infraction
2828 detection system installed and operated by a school district or
2929 open-enrollment charter school in this state.
3030 SECTION 3. Section 707.021, Transportation Code, is amended
3131 to read as follows:
3232 Sec. 707.021. USE OF EVIDENCE FROM PHOTOGRAPHIC TRAFFIC
3333 SIGNAL ENFORCEMENT SYSTEM PROHIBITED. (a) Notwithstanding any
3434 other law and except as provided by Subsection (b), a local
3535 authority may not issue a civil or criminal charge or citation for
3636 an offense or violation based on a recorded image produced by a
3737 photographic traffic signal enforcement system.
3838 (b) This section does not apply to the issuance by a
3939 municipality, county, school district, or open-enrollment charter
4040 school of a civil or criminal charge or citation, as applicable, for
4141 a violation described by Section 545.066 based on the use of
4242 recorded image-based evidence collected from a school bus
4343 infraction detection system installed and operated by a school
4444 district or open-enrollment charter school in this state.
4545 SECTION 4. This Act takes effect September 1, 2025.
