| 9 | 9 | | relating to the notice of intent to obtain a permit from the Texas |

| 10 | 10 | | Commission on Environmental Quality. |

| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 5.552, Water Code, is amended by |
|---|
| 13 | 13 | | amending Subsection (d) and adding Subsection (d-1) to read as |
|---|
| 14 | 14 | | follows: |
|---|
| 15 | 15 | | (d) In addition to providing notice under Subsection |
|---|
| 16 | 16 | | (b)(1), the applicant shall, not later than the 30th day after the |
|---|
| 17 | 17 | | date the commission determines the application to be |
|---|
| 18 | 18 | | administratively complete: |
|---|
| 19 | 19 | | (1) at the site of the facility or proposed facility, |
|---|
| 20 | 20 | | place a sign stating: |
|---|
| 21 | 21 | | (A) that an application for a permit for a |
|---|
| 22 | 22 | | facility at the site has been filed; |
|---|
| 23 | 23 | | (B) the name of and contact information for the |
|---|
| 24 | 24 | | applicant; |
|---|
| 25 | 25 | | (C) the proposed site use; and |
|---|
| 26 | 26 | | (D) the manner in which the applicant may be |
|---|
| 27 | 27 | | contacted for further information; and |
|---|
| 28 | 28 | | (2) comply with any applicable public notice |
|---|
| 29 | 29 | | requirements under Chapters 26 and 27 of this code, Chapter 361, |
|---|
| 30 | 30 | | Health and Safety Code, and rules adopted under those chapters. |
|---|
| 31 | 31 | | (d-1) The sign required by Subsection (d) must: |
|---|
| 32 | 32 | | (1) have dimensions not smaller than 18 inches by 28 |
|---|
| 33 | 33 | | inches; |
|---|
| 34 | 34 | | (2) consist of dark letters on a white background; and |
|---|
| 35 | 35 | | (3) consist of lettering: |
|---|
| 36 | 36 | | (A) at least 1.5 inches in height; and |
|---|
| 37 | 37 | | (B) in block capital letters. |
|---|
| 38 | 38 | | SECTION 2. The changes in law made by this Act apply only to |
|---|
| 39 | 39 | | an application that is filed with the Texas Commission on |
|---|
| 40 | 40 | | Environmental Quality on or after the effective date of this Act. |
|---|
| 41 | 41 | | An application filed before the effective date of this Act is |
|---|
| 42 | 42 | | governed by the law in effect on the date of filing, and that law is |
|---|
| 43 | 43 | | continued in effect for that purpose. |
|---|
| 44 | 44 | | SECTION 3. This Act takes effect September 1, 2025. |
