77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the notice of intent to obtain a permit from the Texas
1010 Commission on Environmental Quality.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 5.552, Water Code, is amended by
1313 amending Subsection (d) and adding Subsection (d-1) to read as
1414 follows:
1515 (d) In addition to providing notice under Subsection
1616 (b)(1), the applicant shall, not later than the 30th day after the
1717 date the commission determines the application to be
1818 administratively complete:
1919 (1) at the site of the facility or proposed facility,
2020 place a sign stating:
2121 (A) that an application for a permit for a
2222 facility at the site has been filed;
2323 (B) the name of and contact information for the
2424 applicant;
2525 (C) the proposed site use; and
2626 (D) the manner in which the applicant may be
2727 contacted for further information; and
2828 (2) comply with any applicable public notice
2929 requirements under Chapters 26 and 27 of this code, Chapter 361,
3030 Health and Safety Code, and rules adopted under those chapters.
3131 (d-1) The sign required by Subsection (d) must:
3232 (1) have dimensions not smaller than 18 inches by 28
3333 inches;
3434 (2) consist of dark letters on a white background; and
3535 (3) consist of lettering:
3636 (A) at least 1.5 inches in height; and
3737 (B) in block capital letters.
3838 SECTION 2. The changes in law made by this Act apply only to
3939 an application that is filed with the Texas Commission on
4040 Environmental Quality on or after the effective date of this Act.
4141 An application filed before the effective date of this Act is
4242 governed by the law in effect on the date of filing, and that law is
4343 continued in effect for that purpose.
4444 SECTION 3. This Act takes effect September 1, 2025.
