| 9 | 9 | | relating to the persons entitled to request a public hearing from |

| 10 | 10 | | the Texas Commission on Environmental Quality related to the |
|---|
| 11 | 11 | | construction of a concrete plant. |
|---|
| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Section 382.058(c), Health and Safety Code, is |
|---|
| 14 | 14 | | amended to read as follows: |
|---|
| 15 | 15 | | (c) For purposes of this section, only a representative of a |
|---|
| 16 | 16 | | school, place of worship, licensed day-care center, hospital, or |
|---|
| 17 | 17 | | medical facility or a person [those persons actually] residing [in |
|---|
| 18 | 18 | | a permanent residence] within 440 yards of the proposed plant may |
|---|
| 19 | 19 | | request a hearing under Section 382.056 as a person who may be |
|---|
| 20 | 20 | | affected. The commission shall adopt rules establishing who |
|---|
| 21 | 21 | | qualifies as a representative of a school, place of worship, |
|---|
| 22 | 22 | | licensed day-care center, hospital, or medical facility under this |
|---|
| 23 | 23 | | section. |
|---|
| 24 | 24 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 25 | 25 | | to a hearing regarding an application for a permit that is submitted |
|---|
| 26 | 26 | | to the Texas Commission on Environmental Quality on or after the |
|---|
| 27 | 27 | | effective date of the rules described by Section 382.058(c), Health |
|---|
| 28 | 28 | | and Safety Code, as amended by this Act. A hearing regarding an |
|---|
| 29 | 29 | | application for a permit that was submitted to the Texas Commission |
|---|
| 30 | 30 | | on Environmental Quality before the effective date of the rules |
|---|
| 31 | 31 | | described by Section 382.058(c), Health and Safety Code, as amended |
|---|
| 32 | 32 | | by this Act, is governed by the law in effect at the time the |
|---|
| 33 | 33 | | application was filed, and the former law is continued in effect for |
|---|
| 34 | 34 | | that purpose. |
|---|
| 35 | 35 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 36 | 36 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 37 | 37 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 38 | 38 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 39 | 39 | | Act takes effect September 1, 2025. |
