| 9 | 9 | | relating to the salary and wages paid to public school employees; |

| 10 | 10 | | making an appropriation. |
|---|
| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 21.402, Education Code, is amended by |
|---|
| 13 | 13 | | adding Subsections (c-2), (c-3), and (d) and amending Subsection |
|---|
| 14 | 14 | | (g) to read as follows: |
|---|
| 15 | 15 | | (c-2) Notwithstanding Subsection (a), for the 2025-2026 |
|---|
| 16 | 16 | | school year, a classroom teacher, full-time librarian, full-time |
|---|
| 17 | 17 | | school counselor certified under Subchapter B, or full-time school |
|---|
| 18 | 18 | | nurse is entitled to a monthly salary that is at least equal to the |
|---|
| 19 | 19 | | sum of: |
|---|
| 20 | 20 | | (1) the monthly salary the employee would have |
|---|
| 21 | 21 | | received for the 2025-2026 school year under the district's salary |
|---|
| 22 | 22 | | schedule for the 2024-2025 school year, if that schedule had been in |
|---|
| 23 | 23 | | effect for the 2025-2026 school year, including any local |
|---|
| 24 | 24 | | supplement and any money representing a career ladder supplement |
|---|
| 25 | 25 | | the employee would have received in the 2025-2026 school year; and |
|---|
| 26 | 26 | | (2) $400. |
|---|
| 27 | 27 | | (c-3) Subsection (c-2) and this subsection expire September |
|---|
| 28 | 28 | | 1, 2026. |
|---|
| 29 | 29 | | (d) A classroom teacher, full-time librarian, full-time |
|---|
| 30 | 30 | | school counselor certified under Subchapter B, or full-time school |
|---|
| 31 | 31 | | nurse employed by a school district in the 2025-2026 school year is, |
|---|
| 32 | 32 | | as long as the employee is employed by the same district, entitled |
|---|
| 33 | 33 | | to a salary that is at least equal to the salary the employee |
|---|
| 34 | 34 | | received for the 2025-2026 school year. |
|---|
| 35 | 35 | | (g) The commissioner may adopt rules to govern the |
|---|
| 36 | 36 | | application of this section, including rules that: |
|---|
| 37 | 37 | | (1) require the payment of a minimum salary under this |
|---|
| 38 | 38 | | section to a person employed in more than one capacity for which a |
|---|
| 39 | 39 | | minimum salary is provided and whose combined employment in those |
|---|
| 40 | 40 | | capacities constitutes full-time employment; and |
|---|
| 41 | 41 | | (2) specify the credentials a person must hold to be |
|---|
| 42 | 42 | | considered a [speech pathologist or] school nurse under this |
|---|
| 43 | 43 | | section. |
|---|
| 44 | 44 | | SECTION 2. Subchapter F, Chapter 48, Education Code, is |
|---|
| 45 | 45 | | amended by adding Section 48.2521 to read as follows: |
|---|
| 46 | 46 | | Sec. 48.2521. ADDITIONAL STATE AID FOR SALARY INCREASES FOR |
|---|
| 47 | 47 | | CERTAIN PROFESSIONAL EMPLOYEES. A school district, including a |
|---|
| 48 | 48 | | school district that is otherwise ineligible for state aid under |
|---|
| 49 | 49 | | this chapter, is entitled to state aid in an amount equal to the |
|---|
| 50 | 50 | | product of $4,000 multiplied by the number of classroom teachers, |
|---|
| 51 | 51 | | full-time librarians, full-time school counselors certified under |
|---|
| 52 | 52 | | Subchapter B, Chapter 21, and full-time school nurses employed by |
|---|
| 53 | 53 | | the district. |
|---|
| 54 | 54 | | SECTION 3. (a) The amount of $1 billion is appropriated |
|---|
| 55 | 55 | | from the economic stabilization fund to the foundation school fund |
|---|
| 56 | 56 | | for distribution by the commissioner of education during the state |
|---|
| 57 | 57 | | fiscal biennium beginning September 1, 2025, to school districts to |
|---|
| 58 | 58 | | provide one-time retention bonuses to district support staff. |
|---|
| 59 | 59 | | (b) The commissioner of education shall distribute the |
|---|
| 60 | 60 | | amount appropriated under this section to school districts on the |
|---|
| 61 | 61 | | basis of the number of full-time district employees, other than |
|---|
| 62 | 62 | | administrators and employees subject to the minimum salary schedule |
|---|
| 63 | 63 | | under Section 21.402, Education Code. |
|---|
| 64 | 64 | | (c) Each school district may use funds distributed under |
|---|
| 65 | 65 | | this section only to increase the salary that would otherwise be |
|---|
| 66 | 66 | | provided to district employees described by Subsection (b) of this |
|---|
| 67 | 67 | | section. |
|---|
| 68 | 68 | | (d) This section takes effect only if this Act is approved |
|---|
| 69 | 69 | | by a vote of two-thirds of the members present in each house of the |
|---|
| 70 | 70 | | legislature, as provided by Section 49-g(m), Article III, Texas |
|---|
| 71 | 71 | | Constitution. |
|---|
| 72 | 72 | | SECTION 4. Section 21.402(c-1), Education Code, is |
|---|
| 73 | 73 | | repealed. |
|---|
| 74 | 74 | | SECTION 5. Section 21.402, Education Code, as amended by |
|---|
| 75 | 75 | | this Act, applies beginning with the 2025-2026 school year. |
|---|
| 76 | 76 | | SECTION 6. (a) Except as otherwise provided by this Act, |
|---|
| 77 | 77 | | this Act takes effect September 1, 2025. |
|---|
| 78 | 78 | | (b) Section 21.402, Education Code, as amended by this Act, |
|---|
| 79 | 79 | | takes effect immediately if this Act receives a vote of two-thirds |
|---|
| 80 | 80 | | of all the members elected to each house, as provided by Section 39, |
|---|
| 81 | 81 | | Article III, Texas Constitution. If this Act does not receive the |
|---|
| 82 | 82 | | vote necessary for immediate effect, that provision takes effect |
|---|
| 83 | 83 | | September 1, 2025. |
