77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to municipal and county firearm buyback programs.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 280, Local Government Code, is amended
1212 by adding Section 280.005 to read as follows:
1313 Sec. 280.005. FIREARM BUYBACK PROGRAMS PROHIBITED. A
1414 municipality or county may not adopt or enforce an ordinance,
1515 order, or other measure in which the municipality or county
1616 organizes, sponsors, or participates in a program that purchases or
1717 offers to purchase firearms with the intent to:
1818 (1) remove firearms from circulation;
1919 (2) reduce the number of firearms owned by civilians;
2020 or
2121 (3) allow individuals to sell firearms without fear of
2222 criminal prosecution.
2323 SECTION 2. This Act takes effect immediately if it receives
2424 a vote of two-thirds of all the members elected to each house, as
2525 provided by Section 39, Article III, Texas Constitution. If this
2626 Act does not receive the vote necessary for immediate effect, this
2727 Act takes effect September 1, 2025.
