10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
11 | 11 | SECTION 1. Chapter 280, Local Government Code, is amended | |
12 | 12 | by adding Section 280.005 to read as follows: | |
13 | 13 | Sec. 280.005. FIREARM BUYBACK PROGRAMS PROHIBITED. A | |
14 | 14 | municipality or county may not adopt or enforce an ordinance, | |
15 | 15 | order, or other measure in which the municipality or county | |
16 | 16 | organizes, sponsors, or participates in a program that purchases or | |
17 | 17 | offers to purchase firearms with the intent to: | |
18 | 18 | (1) remove firearms from circulation; | |
19 | 19 | (2) reduce the number of firearms owned by civilians; | |
20 | 20 | or | |
21 | 21 | (3) allow individuals to sell firearms without fear of | |
22 | 22 | criminal prosecution. | |
23 | 23 | SECTION 2. This Act takes effect immediately if it receives | |
24 | 24 | a vote of two-thirds of all the members elected to each house, as | |
25 | 25 | provided by Section 39, Article III, Texas Constitution. If this | |
26 | 26 | Act does not receive the vote necessary for immediate effect, this | |
27 | 27 | Act takes effect September 1, 2025. |
