99 relating to network standards for Chimeric Antigen Receptor T-Cell
1010 (CAR T) therapy.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Title 8, Subtitle E, Insurance Code, is amended
1313 to create Chapter 1381 as follows:
1414 TITLE 8. HEALTH INSURANCE AND OTHER HEALTH COVERAGES
1515 SUBTITLE E. BENEFITS PAYABLE UNDER HEALTH COVERAGES
1616 CHAPTER 1381. NETWORK STANDARDS FOR CAR T THERAPY
1717 Sec. 1381.001. PURPOSE. The purpose of this Chapter is to
1818 expand access to Chimeric Antigen Receptor T-Cell (CAR T) therapy
1919 by allowing the cancer treatment, if covered by a health benefit
2020 plan, to be provided in any CAR T treatment center that qualifies as
2121 a certified healthcare facility in accordance with the Food and
2222 Drug Administration label governing safety certification, staff
2323 training, adverse event management, patient monitoring, and data
2424 collection.
2525 Sec. 1381.002. APPLICABILITY OF CHAPTER. (a) This chapter
2626 applies only to a health benefit plan that provides benefits for
2727 medical or surgical expenses incurred as a result of a health
2828 condition, accident, or sickness, including an individual, group,
2929 blanket, or franchise insurance policy or insurance agreement, a
3030 group hospital service contract, or an individual or group evidence
3131 of coverage or similar coverage document that is offered by:
3232 (1) an insurance company;
3333 (2) a group hospital service corporation operating under
3434 Chapter 842;
3535 (3) a health maintenance organization operating under
3636 Chapter 843;
3737 (4) an approved nonprofit health corporation that holds a
3838 certificate of authority under Chapter 844;
3939 (5) a multiple employer welfare arrangement that holds a
4040 certificate of authority under Chapter 846;
4141 (6) a stipulated premium company operating under Chapter
4242 884;
4343 (7) a fraternal benefit society operating under Chapter
4444 885;
4545 (8) a Lloyd's plan operating under Chapter 941; or
4646 (9) an exchange operating under Chapter 942.
4747 (b) Notwithstanding any other law, this chapter applies to:
4848 (1) a small employer health benefit plan subject to Chapter
4949 1501, including coverage provided through a health group
5050 cooperative under Subchapter B of that chapter;
5151 (2) a standard health benefit plan issued under Chapter
5252 1507;
5353 (3) a basic coverage plan under Chapter 1551;
5454 (4) a basic plan under Chapter 1575;
5555 (5) a primary care coverage plan under Chapter 1579;
5656 (6) a plan providing basic coverage under Chapter 1601; and
5757 (7) a self-funded health benefit plan sponsored by a
5858 professional employer organization under Chapter 91, Labor Code.
5959 Sec. 1381.003. NETWORK STANDARDS. (a) No health benefit
6060 plan in the state that provides coverage for Chimeric Antigen
6161 Receptor T-Cell (CAR T) therapy may refuse to contract for the
6262 administration of any CAR T therapy by any provider that qualifies
6363 as a certified healthcare facility in accordance with approved
6464 procedure under the CAR-T product license by the FDA.
6565 (b) No health benefit plan in the state that covers CAR T
6666 therapy may deny coverage for the administration of any CAR T
6767 therapy by any provider that qualifies as a certified healthcare
6868 facility in accordance with approved procedure under the CAR-T
6969 product license by the FDA.
7070 (c) This section shall apply to any health benefit plan that
7171 is delivered, issued for delivery, or renewed on or after January 1,
7272 2026.
7373 Sec. 1381.003. RULES. The commissioner shall adopt rules as
7474 necessary to administer this chapter.
7575 SECTION 2. This Act takes effect September 1, 2025.
