9	9	relating to network standards for Chimeric Antigen Receptor T-Cell
10	10	(CAR T) therapy.
11	11	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12	12	SECTION 1. Title 8, Subtitle E, Insurance Code, is amended
13	13	to create Chapter 1381 as follows:
14	14	TITLE 8. HEALTH INSURANCE AND OTHER HEALTH COVERAGES
15	15	SUBTITLE E. BENEFITS PAYABLE UNDER HEALTH COVERAGES
16	16	CHAPTER 1381. NETWORK STANDARDS FOR CAR T THERAPY
17	17	Sec. 1381.001. PURPOSE. The purpose of this Chapter is to
18	18	expand access to Chimeric Antigen Receptor T-Cell (CAR T) therapy
19	19	by allowing the cancer treatment, if covered by a health benefit
20	20	plan, to be provided in any CAR T treatment center that qualifies as
21	21	a certified healthcare facility in accordance with the Food and
22	22	Drug Administration label governing safety certification, staff
23	23	training, adverse event management, patient monitoring, and data
24	24	collection.
25	25	Sec. 1381.002. APPLICABILITY OF CHAPTER. (a) This chapter
26	26	applies only to a health benefit plan that provides benefits for
27	27	medical or surgical expenses incurred as a result of a health
28	28	condition, accident, or sickness, including an individual, group,
29	29	blanket, or franchise insurance policy or insurance agreement, a
30	30	group hospital service contract, or an individual or group evidence
31	31	of coverage or similar coverage document that is offered by:
32	32	(1) an insurance company;
33	33	(2) a group hospital service corporation operating under
34	34	Chapter 842;
35	35	(3) a health maintenance organization operating under
36	36	Chapter 843;
37	37	(4) an approved nonprofit health corporation that holds a
38	38	certificate of authority under Chapter 844;
39	39	(5) a multiple employer welfare arrangement that holds a
40	40	certificate of authority under Chapter 846;
41	41	(6) a stipulated premium company operating under Chapter
42	42	884;
43	43	(7) a fraternal benefit society operating under Chapter
44	44	885;
45	45	(8) a Lloyd's plan operating under Chapter 941; or
46	46	(9) an exchange operating under Chapter 942.
47	47	(b) Notwithstanding any other law, this chapter applies to:
48	48	(1) a small employer health benefit plan subject to Chapter
49	49	1501, including coverage provided through a health group
50	50	cooperative under Subchapter B of that chapter;
51	51	(2) a standard health benefit plan issued under Chapter
52	52	1507;
53	53	(3) a basic coverage plan under Chapter 1551;
54	54	(4) a basic plan under Chapter 1575;
55	55	(5) a primary care coverage plan under Chapter 1579;
56	56	(6) a plan providing basic coverage under Chapter 1601; and
57	57	(7) a self-funded health benefit plan sponsored by a
58	58	professional employer organization under Chapter 91, Labor Code.
59	59	Sec. 1381.003. NETWORK STANDARDS. (a) No health benefit
60	60	plan in the state that provides coverage for Chimeric Antigen
61	61	Receptor T-Cell (CAR T) therapy may refuse to contract for the
62	62	administration of any CAR T therapy by any provider that qualifies
63	63	as a certified healthcare facility in accordance with approved
64	64	procedure under the CAR-T product license by the FDA.
65	65	(b) No health benefit plan in the state that covers CAR T
66	66	therapy may deny coverage for the administration of any CAR T
67	67	therapy by any provider that qualifies as a certified healthcare
68	68	facility in accordance with approved procedure under the CAR-T
69	69	product license by the FDA.
70	70	(c) This section shall apply to any health benefit plan that
71	71	is delivered, issued for delivery, or renewed on or after January 1,
72	72	2026.
73	73	Sec. 1381.003. RULES. The commissioner shall adopt rules as
74	74	necessary to administer this chapter.
75	75	SECTION 2. This Act takes effect September 1, 2025.
