77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to fentanyl prevention and drug poisoning awareness
1010 education for students enrolled in public institutions of higher
1111 education.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter Z, Chapter 51, Education Code, is
1414 amended by adding Section 51.9363 to read as follows:
1515 Sec. 51.9363. FENTANYL PREVENTION AND DRUG POISONING
1616 AWARENESS EDUCATION. (a) In this section, "institution of higher
1717 education" and "private or independent institution of higher
1818 education" have the meanings assigned by Section 61.003.
1919 (b) Each institution of higher education shall provide
2020 research-based instruction related to fentanyl prevention and drug
2121 poisoning awareness to entering undergraduate students as soon as
2222 practicable during the students' first semester or term at the
2323 institution.
2424 (c) The instruction required by this section must include:
2525 (1) suicide prevention;
2626 (2) prevention of the abuse of and addiction to
2727 fentanyl;
2828 (3) awareness of local institution and community
2929 resources and any processes involved in accessing those resources;
3030 and
3131 (4) health education that includes information about
3232 substance use and abuse, including young adult substance use and
3333 abuse.
3434 (d) The instruction required by this section may be provided
3535 online and by an entity or an employee or agent of an entity that is:
3636 (1) an institution of higher education or private or
3737 independent institution of higher education;
3838 (2) a library;
3939 (3) a community service organization;
4040 (4) a religious organization;
4141 (5) a local public health agency; or
4242 (6) an organization employing mental health
4343 professionals.
4444 SECTION 2. Section 51.9363, Education Code, as added by
4545 this Act, applies beginning with undergraduate students who
4646 initially enroll in a public institution of higher education for
4747 the 2026 fall semester.
4848 SECTION 3. This Act takes effect immediately if it receives
4949 a vote of two-thirds of all the members elected to each house, as
5050 provided by Section 39, Article III, Texas Constitution. If this
5151 Act does not receive the vote necessary for immediate effect, this
5252 Act takes effect September 1, 2025.
