|---|
| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Subchapter Z, Chapter 51, Education Code, is |
|---|
| 14 | 14 | | amended by adding Section 51.9363 to read as follows: |
|---|
| 15 | 15 | | Sec. 51.9363. FENTANYL PREVENTION AND DRUG POISONING |
|---|
| 16 | 16 | | AWARENESS EDUCATION. (a) In this section, "institution of higher |
|---|
| 17 | 17 | | education" and "private or independent institution of higher |
|---|
| 18 | 18 | | education" have the meanings assigned by Section 61.003. |
|---|
| 19 | 19 | | (b) Each institution of higher education shall provide |
|---|
| 20 | 20 | | research-based instruction related to fentanyl prevention and drug |
|---|
| 21 | 21 | | poisoning awareness to entering undergraduate students as soon as |
|---|
| 22 | 22 | | practicable during the students' first semester or term at the |
|---|
| 23 | 23 | | institution. |
|---|
| 24 | 24 | | (c) The instruction required by this section must include: |
|---|
| 25 | 25 | | (1) suicide prevention; |
|---|
| 26 | 26 | | (2) prevention of the abuse of and addiction to |
|---|
| 27 | 27 | | fentanyl; |
|---|
| 28 | 28 | | (3) awareness of local institution and community |
|---|
| 29 | 29 | | resources and any processes involved in accessing those resources; |
|---|
| 30 | 30 | | and |
|---|
| 31 | 31 | | (4) health education that includes information about |
|---|
| 32 | 32 | | substance use and abuse, including young adult substance use and |
|---|
| 33 | 33 | | abuse. |
|---|
| 34 | 34 | | (d) The instruction required by this section may be provided |
|---|
| 35 | 35 | | online and by an entity or an employee or agent of an entity that is: |
|---|
| 36 | 36 | | (1) an institution of higher education or private or |
|---|
| 37 | 37 | | independent institution of higher education; |
|---|
| 38 | 38 | | (2) a library; |
|---|
| 39 | 39 | | (3) a community service organization; |
|---|
| 40 | 40 | | (4) a religious organization; |
|---|
| 41 | 41 | | (5) a local public health agency; or |
|---|
| 42 | 42 | | (6) an organization employing mental health |
|---|
| 43 | 43 | | professionals. |
|---|
| 44 | 44 | | SECTION 2. Section 51.9363, Education Code, as added by |
|---|
| 45 | 45 | | this Act, applies beginning with undergraduate students who |
|---|
| 46 | 46 | | initially enroll in a public institution of higher education for |
|---|
| 47 | 47 | | the 2026 fall semester. |
|---|
| 48 | 48 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 49 | 49 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 50 | 50 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 51 | 51 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 52 | 52 | | Act takes effect September 1, 2025. |
|---|
