77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the civil prosecution of offenses involving certain
1010 municipal parking ordinances; authorizing a civil fine.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 601.001, Local Government Code, is
1313 amended to read as follows:
1414 Sec. 601.001. PARKING ON PRIVATE PROPERTY. (a) A
1515 municipality by ordinance may regulate the parking of motor
1616 vehicles on private property and may enforce the ordinance in the
1717 same manner that it enforces ordinances regulating parking in
1818 public no-parking zones, including the impoundment of offending
1919 vehicles.
2020 (b) As provided by Chapter 682, Transportation Code, a
2121 municipality with a population of 1.9 million or more may:
2222 (1) declare the violation of a municipal ordinance
2323 relating to the parking of an unattended motor vehicle in the front
2424 or side yard of a single-family residence in a residential area to
2525 be a civil offense; and
2626 (2) by ordinance establish an administrative
2727 adjudication hearing procedure under which a civil fine may be
2828 imposed.
2929 SECTION 2. This Act takes effect September 1, 2025.
