77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the expansion of eligibility for Medicaid to certain
1010 women.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter B, Chapter 32, Human Resources Code,
1313 is amended by adding Section 32.02473 to read as follows:
1414 Sec. 32.02473. EXPANDED ELIGIBILITY FOR MEDICAL ASSISTANCE
1515 FOR CERTAIN WOMEN OF REPRODUCTIVE AGE. (a) Notwithstanding any
1616 other law, the commission shall provide medical assistance to each
1717 woman in this state:
1818 (1) who is of reproductive age, including each woman
1919 who is at least 19 years of age or older but younger than 50 years of
2020 age;
2121 (2) who has a household income that is at or below 133
2222 percent of the federal poverty level;
2323 (3) who applies for the assistance; and
2424 (4) for whom federal matching money is available.
2525 (b) The executive commissioner shall adopt rules necessary
2626 to implement this section.
2727 SECTION 2. Section 32.02473, Human Resources Code, as added
2828 by this Act, applies only to an initial determination or
2929 recertification of eligibility of an individual for medical
3030 assistance under Chapter 32, Human Resources Code, made on or after
3131 the date the section is implemented, regardless of the date the
3232 individual applied for that assistance.
3333 SECTION 3. As soon as practicable after the effective date
3434 of this Act, the executive commissioner of the Health and Human
3535 Services Commission shall take all necessary actions to expand
3636 eligibility for medical assistance under Chapter 32, Human
3737 Resources Code, in accordance with Section 32.02473, Human
3838 Resources Code, as added by this Act, including notifying
3939 appropriate federal agencies of that expanded eligibility.
4040 SECTION 4. If before implementing any provision of this Act
4141 a state agency determines that a waiver or authorization from a
4242 federal agency is necessary for implementation of that provision,
4343 the agency affected by the provision shall request the waiver or
4444 authorization and may delay implementing that provision until the
4545 waiver or authorization is granted.
4646 SECTION 5. This Act takes effect September 1, 2025.
