9 | 9 | | relating to the expansion of eligibility for Medicaid to certain |

10 | 10 | | women. |

11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Subchapter B, Chapter 32, Human Resources Code, |
---|
13 | 13 | | is amended by adding Section 32.02473 to read as follows: |
---|
14 | 14 | | Sec. 32.02473. EXPANDED ELIGIBILITY FOR MEDICAL ASSISTANCE |
---|
15 | 15 | | FOR CERTAIN WOMEN OF REPRODUCTIVE AGE. (a) Notwithstanding any |
---|
16 | 16 | | other law, the commission shall provide medical assistance to each |
---|
17 | 17 | | woman in this state: |
---|
18 | 18 | | (1) who is of reproductive age, including each woman |
---|
19 | 19 | | who is at least 19 years of age or older but younger than 50 years of |
---|
20 | 20 | | age; |
---|
21 | 21 | | (2) who has a household income that is at or below 133 |
---|
22 | 22 | | percent of the federal poverty level; |
---|
23 | 23 | | (3) who applies for the assistance; and |
---|
24 | 24 | | (4) for whom federal matching money is available. |
---|
25 | 25 | | (b) The executive commissioner shall adopt rules necessary |
---|
26 | 26 | | to implement this section. |
---|
27 | 27 | | SECTION 2. Section 32.02473, Human Resources Code, as added |
---|
28 | 28 | | by this Act, applies only to an initial determination or |
---|
29 | 29 | | recertification of eligibility of an individual for medical |
---|
30 | 30 | | assistance under Chapter 32, Human Resources Code, made on or after |
---|
31 | 31 | | the date the section is implemented, regardless of the date the |
---|
32 | 32 | | individual applied for that assistance. |
---|
33 | 33 | | SECTION 3. As soon as practicable after the effective date |
---|
34 | 34 | | of this Act, the executive commissioner of the Health and Human |
---|
35 | 35 | | Services Commission shall take all necessary actions to expand |
---|
36 | 36 | | eligibility for medical assistance under Chapter 32, Human |
---|
37 | 37 | | Resources Code, in accordance with Section 32.02473, Human |
---|
38 | 38 | | Resources Code, as added by this Act, including notifying |
---|
39 | 39 | | appropriate federal agencies of that expanded eligibility. |
---|
40 | 40 | | SECTION 4. If before implementing any provision of this Act |
---|
41 | 41 | | a state agency determines that a waiver or authorization from a |
---|
42 | 42 | | federal agency is necessary for implementation of that provision, |
---|
43 | 43 | | the agency affected by the provision shall request the waiver or |
---|
44 | 44 | | authorization and may delay implementing that provision until the |
---|
45 | 45 | | waiver or authorization is granted. |
---|
46 | 46 | | SECTION 5. This Act takes effect September 1, 2025. |
